AgreementMEMORANDUMOFUNDERSTANDINGANDINTERLOCALAGREEMENTBETWEENTHEBUREAUOFLANDMANAGEMENTSPOKANEDISTRICTOFFICEANDTHEKITTITASCOUNTYSHERIFF'SOFFICEI.PURPOSEThisMemorandumofUnderstanding(MOU)isenteredpursuanttotheauthorityofRCW(RevisedCodeofWashington)Chapter39.34andprovidesfortheincreasedprotectionofpersonsandpropertyonthepubliclandsandroadsadministeredbytheUnitedStatesDepartmentoftheInterior,BureauofLandManagement(BLM),throughcooperationbetweentheKittitasCountySheriffsOfficeandtheBLM,bythegrantingandacceptanceofauthorityforBLMlawenforcementofficerstoenforceStateandlocallawsandregulationspursuanttothisMOU.II.AUTHORITYA.BureauofLandManagementSection303(d)oftheFederalLandPolicyandManagementActof1976(43U.S.C.1733(d))providesthat,inconnectionwiththeadministrationandregulationoftheuseandoccupancyofthepubliclands,theSecretaryisauthorizedtocooperatewiththeregulatoryandlawenforcementofficialsofanyStateorpoliticalsubdivisionthereofintheenforcementofthelawsorordinancesofsuchStateorsubdivision.B.KittitasCountySheriffsOfficeSection36.28.020oftheRCWgrantstheSheriffofKittitasCountythepowertodeputizepersonsinwritingtoperformparticulartasks.ThepersondesignatedbelowbyBLMhasbeenspeciallycommissionedbytheKittitasCountySheriffpursuanttothatstatuteandasdefinedinRCW10.93.020(5).Attachment6-1 III.DEFINITIONSA.PublicLands-MeansanylandandinterestinlandownedbytheUnitedStateswithintheseveralStatesandadministeredbytheSecretaryoftheInterior,throughtheBLMwithoutregardtohowtheUnitedStatesacquiredownership,except:1.LandslocatedontheouterContinentalShelf2.LandsheldforthebenefitofIndians,Aleuts,andEskimos.43U.S.C,1702(e)B.LawEnforcementOfficer(LEO)-LawEnforcementRangersandSpecialAgentsemployedbytheBLMwhohavebeendelegatedlawenforcementauthoritybytheDirector,BLM.C.StateDirector-TheStateDirector,BLM,Oregon/WashingtonStateOfficeD.SpecialAgent-in-Charge(SAC)-BLMSpecialAgent-inChargefortheOregon/WashingtonStateOfficeIV.PROCEDURESA.TheKittitasCountySheriffhastheauthoritytoenforcethelawsoftheStateofWashingtonandtheordinancesofKittitasCountyonsuchpubliclandsadministeredbytheBLMthatliewithintheconfinesofKittitasCounty;andislimitedastotheamountofprotection,patrol,andinvestigationthatcanbeprovidedonthosepubliclands,waters,roads,andtrailsadministeredbytheBLMwithinKittitasCounty.B.TheStateDirector,SAC,andtheKittitasCountySheriffherebymutuallyagreethatitisdesirabletocooperateandcollaborateinbetterutilizingtheresourcesofbothagencieswhileprovidingformoreadequateprotectionofpersonsandpropertyonthepubliclandsasfollows:1.TheKittitasCountySheriffagreestocontinuetoenforcethecivilandcriminallawsofWashingtonStateandKittitasCountyonthepubliclands,waters,roads,andtrailsadministeredbytheBLMwithinthenormalscopeofdutytotheextentofcurrentfinancialandmanpowerresourceswithoutreimbursementbytheBLM.2.TheBLMagrees,withintheavailabilityoffundsandestablishedFederalregulationsandpolicies,toenforcetheauthorizedFederallawsandregulationspertainingtothepubliclandsadministeredbytheBLM,andStateAttachment6-2 andlocallawsinconnectionwiththeirdutiesintheadministrationandregulationoftheuseandoccupancyofthepubliclandsasdefinedherein.3.TheKittitasCountySheriff'sOfficeandtheBLMmutuallyagreetoprovidethemaximumcooperation,assistance,andcoordinationpossible,withintheavailabilityoffundsandestablishedlaws,regulations,andpoliciesgoverningtherespectiveagenciesthatwillassuretheprotectionofpersonsandpropertyonthepubliclands,waters,roads,andtrailsadministeredbytheBLMwithintheconfinesofKittitasCounty.4.TheKittitasCountySherifffurtheragreesthatpursuanttoRCW36.28.020hewilldesignateBLMLEO,RangerTimothyLNicoulinJr.,asaSpecialDeputyoftheKittitasCountySheriff'sOfficeforenforcementofWashingtonStatelawsandregulationsandKittitasCountyordinancesinKittitasCountyTheKittitasCountySherifffurtherunderstandsandagreesthatRangerNicoulinislimitedbytheBLMtoexercisesaidenforcementauthorityonlyinconnectionwithhisdutiesintheadministrationandregulationoftheuseandoccupancyofthepubliclandsasdefinedherein.RangerNicoulinwillbefurtherinstructedthattheBLMmaydisciplineanyofitsLEOswhoexerciseStateand/orlocallawenforcementauthorityinviolationoftherestrictionsimposeduponthembytheBLM.Priortoanysuchdesignation,theBLMagreestoprovideanytrainingrequiredbyWashingtonStatelawortheKittitasCountySheriff'sOfficetoRangerNicoulin.ItisunderstoodandagreedthattheauthoritygrantedbytheKittitasCountySheriffincludestheauthoritytoexecuteanyvalidStateorlocalwarrantthattheKittitasCountySheriff'sOfficehastheauthoritytoexecuteandforwhichtheKittitasCountySheriffsOfficehastheauthoritytogrant.However,itisunderstoodthattheBLMlimitsRangerNicoulintoexercisesuchauthorityonlyinconnectionwithhisdutiesintheadministrationandregulationoftheuseandoccupancyofthepubliclandsasdefinedherein,and,whenfeasible,upontherequestoftheKittitasCountySheriffsOffice.5.TheBLMfurtheragreestotakethefollowingmutuallyagreeduponactionsrelatedtoviolationsofWashingtonStatelawsandKittitasCountyordinances,a.Torespondtorequestsforback-upservicestoeachotherinemergency"officerneedsassistance"situations,asmaybereasonable,prudent,andnecessaryunderthecircumstances.ItisfurtherunderstoodandagreedthatallofficerswillbeinstructedthatRangerNicoulinislimitedtorespondingtothosesituationsnotonpubliclandswhereheistheclosestavailableofficerandiswithinreasonableproximity,consideringallfactors,tothesituationrequiringassistance.b.Toissuecitations,arrest,and/orreleasepersonssuspectedofviolationsofWashingtonStatelaws,regulations,orKittitasCountyordinancesrelatedAttachment6-3 totheadministrationandregulationoftheuse,occupancy,anddevelopmentofPublicLands.c.TodetainpersonssuspectedofviolatingWashingtonStatelaws,regulations,orKittitasCountyordinances,anywitnessestothoseviolations,andtoprotectanyrelatedcrimescene,pendingarrivalofthestateorlocalagencyhavingprimaryjurisdiction.d.Toarrest,transport,andreleasetoanavailablestateorlocallawenforcementofficeranypersonhavingavalidStateorlocalwarrantforhis/herarrestwhenrequestedbytheKittitasCountySheriffsOffice.V.SCOPEANDCONDITIONSA.Neitherpartyshallbeliabletotheotherortoitsagentsoremployeesforanyloss,damage,personalinjury,ordeathoccurringinconsequenceoftheperformanceofthisMOU,exceptasprovidedherein.B.Nomemberof,ordelegatetoCongress,orStateOfficial,shallbeadmittedtoanyshareorpartofthisMOU,oranybenefitthatmayarisetherefrom.C.RangerNicoulinwillremainunderthesupervisionandresponsibilityoftheBLM.RangerNicoulinshallnotbeconsideredascomingwithinthescopeoftheKittitasCountySheriff'sOfficeemploymentandnoneofthebenefitsofKittitasCountySheriff'sOfficewillbeconferredunderthisMOU.D.DuringtheperformanceofthisMOU,theparticipantsagreetoabidebythetermsofExecutiveOrder11246onnondiscriminationandwillnotdiscriminateagainstanypersonbecauseofrace,color,religion,sex,age,disability,ornationalorigin.Theparticipantswilltakeaffirmativeactiontoensurethatapplicantsareemployedwithoutregardtotheirrace,color,religion,sex,age,disability,ornationalorigin.E.Eachpartywillfurnishwritteninformationnecessaryformutualenforcementoperations.F.AnyissueswhichcannotbereconciledbetweentheKittitasCountySheriff'sOfficeandRangerNicoulinoranyissuethataffectseitherparty'sperformanceunderthisMOUshallbereferredtotheSAC.TheSACwillberesponsibleforcoordinatingwiththeappropriateofficialstomutuallyresolveanyissue.G.NothinginthisMOUwillbeconstruedasaffectingtheauthoritiesofeitherpartyorasbindingbeyondtheirrespectiveauthorities.H.NothinginthisMOUshallobligatetheBLMtoexpendappropriationortoenterintoanycontractorotherobligation.Specificworkprojectsoractivitiesthatinvolvethetransferoffunds,service,orpropertybetweenthepartiestothisMOUwillrequiretheexecutionofseparateagreementsorcontracts,contingentuponAttachment6-4 theavailabilityoffundsasappropriatedbyCongress.Eachsubsequentagreementorarrangementinvolvingthetransferoffunds,service,orpropertyshallbemadeinwritingandshallbeindependentlyauthorizedbyappropriatestatutoryauthorityandregulations,includingthoseapplicabletoprocurementactivities.I.Subjecttoavailabilityoffunds,eachpartyagreestofundtheirownexpensesassociatedwiththeimplementationofthisMOU.NothingcontainedhereinshallbeconstruedasobligatingtheBLMtoanyexpenditureorobligationoffundsinexcessorinadvanceofappropriations,inaccordancewiththeAnti-DeficiencyAct,31U.S.C.§1341.J.AnyrecordsordocumentsgeneratedasaresultofthisMOUshallbepartoftheofficialBLMrecordmaintainedinaccordancewithapplicableBLMRecordsManagementpolicies.AnyrequestforreleaseofrecordsassociatedwiththeimplementationofthisMOUtoanyoneoutsidethepartiesmustbedeterminedbasedonapplicablelaws,includingtheFreedomofInformationActandthePrivacyAct.K.ThisMOUshallbeeffectivefromthedateofexecutionandshallremainineffectuntilterminatedwitha60-daywrittennoticefromeitherpartytotheotherparty.ThisMOUmaybemodifiedoramendeduponwrittenrequestofeitherpartyandwrittenconcurrenceoftheotherparty.L.ThisAgreementshallbefiledasrequiredbyRCW39.34.040uponratification.VI.APPROVEDClaytonMyersJoseLinaresKittitasCountySheriffStateDirector(Acting),Oregon/WashingtonBureauofLandManagementDateDateAttachment6-5
