Conduct a Public Hearing to consider the purchase of Real
Property described as Tax Parcel 58933.
BACKGROUND: On October, 7, 2018 Kittitas County entered into an
agreement with the Trust for Public Land for the purchase
of real property (land and water rights). This acquisition
would secure approximately 160.3 acres of land (tax parcel
58933) and two associated senior water rights. After
acquisition, the land would be managed by the Flood
Control Zone District as open space for flood hazard
reduction, fish and wildlife enhancement, and agriculture
uses.
Purchase of this real property is contingent on the Board of
County Commissioners adopting a resolution authorizing
the purchase and on Kittitas County receiving funding from
Ecology in an amount sufficient to fund the total purchase
price of the property. Kittitas County has applied for
funding the Department of Ecology's Floodplain by Design
program, which requires a grant agreement
INTERACTION: Public Works
RECOMMENDATION: Conduct a Public Hearing to consider the Purchase of Real
Property described as Parcel 58933 and approve enabling
documents for the Authorizing the Purchase of Real
Property, the Chair's Signature on Closing Documents, and
the Public Works Director to execute the Floodplains by
Design Grant Agreement.
HANDLING: Return one original to Public Works

RESOLUTION NO.
RESOLUTION RATIFYING PURCHASE AND SALE AGREEMENT AND AUTHORIZING
CHAIRMAN SIGNATURE ON CLOSING DOCUMENTS AND AUTHORIZING THE
DIRECTOR OF PUBLIC WORKS TO EXECUTE THE GRANT AGREEMENT
WHEREAS: On October 7, 2019 the Kittitas County Board of Commissioners entered into a Purchase
and Sale Agreement with the Trust for Public Land for the purchase of approximately
160.3 acres of land and two associated senior water rights; and
WHEREAS: The Purchase and Sale Agreement states that the County has no obligation to purchase
the property until a number of contingencies have been met, including the adoption by
the Kittitas County Board of Commissioners of a resolution authorizing the purchase, and
WHEREAS: An additional contingency identified in the Purchase and Sale Agreement is that the
County has received funding from the Department of Ecology to fund the Total Purchase
Price of the subject price; and
WHEREAS: The Department of Ecology Floodplains by Design program necessitates a grant
agreement to award funding for the purchase of the subject property; and
WHEREAS: A public hearing was held, after due notice, on October 15, 2019 at 2:00 pm to discuss
the authorization of such purchase, and whether the purchase was in the interest of the
County.
THEREFORE BE IT RESOLVED, Kittitas County shall purchase property from the seller, as
contemplated in the Purchase and Sale Agreement that is hereby ratified; and
BE IT FURTHER RESOLVED, once all contingencies in the Purchase and Sale Agreement have been
met, the Chair of the Kittitas Board of County Commissioners is authorized to execute
any further documents, on behalf of Kittitas County, necessary to close the transaction;
and
BE IT FURTHER RESOLVED, the Kittitas County Board of County Commissioners authorizes the
Director of Public Works to execute the Floodplains by Design Grant Agreement.
