SECOND AMENDMENT TO AGREEMENT <br /> <br />BETWEEN <br /> <br />KITTITAS COUNTY <br /> <br />AND <br /> <br />WASTE MANAGEMENT OF WASHINGTON, INC. <br /> <br />THlS SECOND AMENDMENT TO AGREEMENT ("First Amendment") is entered into <br />as of February 17, 2017 ("Effective Date") by and between Kittitas County ("County") and <br />Waste Management of Washington, Inc. ("Company"). <br />RECITALS <br />A. County and Company are parties to that certain Agreement for Operation of Transfer <br />Stations, Hauling and Disposal of Municipal Solid Waste, Hauling of Inert, <br />Demolition Debris Waste, and Hauling, Processing and Marketing ofRecyclables <br />effective July 1,2010 (the "Agreement"); <br />B. County and Company amended the Agreement on July 1,2015, extending the tenn of <br />the Agreement and adjusting fees and compensation; and <br />C. County and Company now desire to further amend the Agreement. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the mutual covenants and promises contained <br />herein, the receipt and sufficiency of which are hereby acknowledged , the parties mutually agree <br />as follows: <br />1. Transfer Station Operations; Tires . Section VU(C)(viii) IS hereby amended as <br />follows (additions in underline and deletions in strikethrough): <br />Tires. The Company shall direct customers to stack tires neatly and shall be <br />responsible for maintaining tires in a neat and orderly fashion. The Company shall <br />accept tires, as defined herein, at Lower County and Upper County transfer <br />station~ from the public commercial and agricultural sources, and shall segregate <br />tires from MSW and other wastes. <br />Lower County Transfer Station . The Company shall load tires into top <br />load containers provided by the County at Lower County Transfer Station. <br />The County may arrange tires in containers to maximize loading. The <br />County will arrange for supplying the removal of full containers of tires. <br />There is no pay item for this work. All cost incurred by the Company in <br />regard to tires at Lower County Transfer Station shall be considered <br />incidental to the operation of the transfer stations . <br />Page 1 of3
