TO APPROVE THE CHAIR'S SIGNATURE ON PROJECT AGREEMENT
#1917-01 FOR RURAL ARTERIAL TRUST ACCOUNT FUNDS FROM THE
COUNTY ROAD ADMINISTRATION BOARD FOR THE MANASTASH ROAD
BRIDGE REPLACEMENT PROJECT
WHEREAS: The Mana sta s h Road Bridge project will replace the deteriorated bridge
over Manastash Creek at MP 10 .6 0. This bridge is currently load
restricted and is the only access in and out for many residents and
commercial operations; and
WHEREAS: Public Works submitted a Project Pro s pectus reque sting Rural Arterial
Program funds from the County Road Admini s tration Board (CRAB) for
the replacement of sai d bridge in the amount of $1 ,958,000 ; and
WHEREAS: Public Work s was notified by CRAB on August 17,2017 that the design
funding necessary for the project had been awarded in the amount of
$315,480; and
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in
the best interest of the public, doe s hereby approve the Chair's signature
on Project Agreement #1917-01 for Rural Arterial Trust Account Funds
from the County Road Administration Board for the Manastash Road
Bridge Replacement Project.

The State of Wa shington County Road Administration Board (CRABoard) and Kittitas County mutually agree as
follows:
(1) The funds hereby authorized are for completion of the propo sed proj ect as defined by chapter 36.79 RCW
Roads and bridges -rural arterial program.
(2) The County is in compliance with the provisions of chapter 136-150 WAC regarding eligibility for Rural
Arterial Trust Account (RATA) funds . If the County is found not to be in compliance with these provisions, such non
compliance may be cause for the CRABoard to withdraw or deny the Certificate of Good Practice ofthe County and
require pay back of any RATA funds that have been paid to the County for this project.
(3) If the project is reconstruction, the County shall gain approval from WSDOT (chapter 43.32 RCW) for all
deviations from the design standards listed in the Local Agency Guidelines prior to construction.
(4) If the project is 3R (resurfacing re s toration and rehabilitation), the County shall document its de s ign
con s iderations for the proposed improvements in keeping with 3R standards as listed in the Local Agency Guidelines.
(5) The project shall be constructed in accordance with the information furnished to the CRABoard, and the plans
and specifications prepared by the county engineer.
(6) Phased construction methodology is permitted upon notification by the County E ngineer of the phasing plan as
authorized under WAC 136-170-030. Failure by the county to notify the CRABoard of phasing plan at least 15 days
prior to commencement of construction may result in withdrawa l of funding by the CRABoard and county forfeiture of
all RATA funds expended.
(7) The County shall notify th e CRABoard when a contract has been awarded and/or when construction has
started, and when the project has been completed.
(8) The County shall reimburse the RATA in the event a project post audit reveals improper expenditurc of RATA
funds .
(9) Costs of the project which exceed the amount of RATA fund s authorized by the CRABoard, set forth above,
and the required matching funds and other funds represented by the county to be committed to the project, shall be paid
by the County as necessary to complete the project .s submitted to the CRABoard.

(II) The CRABoard hereby agrees to re imb urse the county from RATA fund s a ll ocated , and not otherwise, for it s
reimburs ab le costs not to exceed the amo unt above s pecified.
(12) The CRABoard w ill reimburse counties on th e bas is of mon thl y progress payment vo uchers rece ived a nd
approved on ind iv idu al projects in th e o rd e r in which they a re rece iv ed in the CRABoard office, a nd s ubject to th e
availability of RATA funds apportioned to the region. S uch obligation to reimbu rse RATA fund s extends o nl y to
proj ect cos ts incurred after the da te of proje ct approval by the CRABoard.
(13) Either the CRA Board o r the County ma y request c ha nges to th e provision s conta ined in thi s agreement. Such
changes sha ll be mutually agree d up o n and in corporated by written amend m en t to thi s agr eement. No variation or
alteration of the term s of thi s agreement sha ll be val id unles s mad e in w riting and s ign ed by authorized represe ntat iv e s
of th e CRA Board or th e County hereto .
(14) Du r ing th e te r m ofthis agreement and for a period not less th an s ix (6) years from the date of final payment by
the CRABoard, the record s and accounts pertaining to thi s agreemen t are to be kept avai labl e for inspection a nd a udit
and copies of all records, acco unts, documents, o r other d ata pe rt a inin g to th e agreement w i 11 be furnished upon
req ues t. If a ny liti ga tion , c laim , or a udit is commenced, the records and accounts along with suppo nin g documentation
shall be retained until sa id li tigat ion , c laim , or a udit finding ha s been reso lved even though s uc h liti gat ion, claim , or
audit continues past th e s ix yea r retention period .
IN CONS IDERATI ON of the allocation by th e CRABoard RATA funds to th e project in the amount set out a bove, the
County hereby agrees that as condition precede nt to payment of any RATA fund s allocated at a ny time to th e a bove
referenc ed project, it accepts and will comp ly with the term s of this agreement, including th e te nn s and conditi on s set
fOlth in C hapter 49, La w s of 1983 , I st Ex. Sess. (c hapter 36.79 RCW); the applic a bl e rules of Title 136 WA C and a ll
representatiu ns made to the CRABoard upon whi ch th e fund allocation was based ; all of which are familiar to and
within th e know ledge of th e co un ty a nd a re incorporated herein and made a part of t hi s agreement , although not
attached.
Thi s agree ment supersedes all pri or agree ments issued using th e project number li sted above and s ha ll be valid and
binding only if it is s ig ned a nd retume d to th e CRABoard office wi thin 45 days of its mailing by the CRABoard.
