RESOLUTION
NO. 2017 -075
DECLARATION OF EMERGENCY -AUDITOR'S OFFICE ASBESTOS
REMOVAL
WHEREAS: the Kittitas County Maintenance Department has reported to the Board of County
Commissioners that an on-going remodeling project in the Office of the Kittitas County
Auditor has resulted in the inadvertent and. unexpected discovery of asbestos in some of
thecon~ction;and
WHEREAS: the presence of asbestos and the risk of disturbance thereof in the course of the project
presents a significant threat to the safety of employees and citizens; and
WHEREAS: the project is stalled until that asbestos is properly removed and disposed of in a safe and
lawful manner, which requires compliance with strict standaL'ds for such work; and
WHEREAS: the working conditions of the Auditor's staff are substantially and negatively impfWted by
the inability to complete the remodeling; and
WHEREAS: the Auditor's Office has statutory duties that are not discretionary; and
WHEREAS: due to those duties, the Auditor's Office must remain open for business to the same
extent as if the remodeling project were not in progress; and
WHEREAS: the only manner by which the remodeling project is able to be continued and the
Auditor's Office is able to be open during its normal hours is to complete the asbestos
removal and disposal on the coming weekend, and
WHEREAS: declaring a state of emergency, by which the Maintenanoe Department is able to obtain
the services of a contractor qualified to safely and lawfully remove and dispose of the
asbestos is necessary for restoration to a condition of usefulness of this public property.
Justification falls under RCW 36.40.180 -restomtion of public property the usefulness of
which has been destroyed by fWcident, and RCW 36.32.270 and RCW 39.04.280 which
allow for competitive bids to be waived in the event. of the emergency.
RESOLVED: That it is hereby declared that there has been an emergency due to the
above described circumstances, and that the Board of CoWlty Commissioners and
Maintenance Department are authorized to enter into contracts and incur obli,gations
necessary to combat such emergency to protect the health and safety of staff, inmates and
property, specifically the Personal Services Agreement (contract) with TriValley
Construction, 1008 N. lit. Street, Yakima WA, to properly remove and dispose of the
asbestos referred to above.
