AMENDMENT NO. 4 TO PROFESSIONAL SERVICES AGREEMENT THIS AMENDMENT is made and entered into as of this ~of1"l day of December, 2016, by and between Kittitas County, Washington, hereinafter referred to as "the County," and Van Ness Feldman LLP, a limited liability partnership, hereinafter referred to as "Consultant." WHEREAS, the County entered into the original Professional Services Agreement ("PSA") effective June 2, 2009, with the law firm of GordonDerr LLP for planning services, and WHEREAS, on February 22, 2012, the County and Consultant executed Amendment No. 1 to the PSA to substitute Consultant's name to Van Ness Feldman GordonDerr; and WHEREAS, on August 21, 2012, the County and Consultant executed Amendment No. 2 to the PSA to amend Exhibit "B" to the above-mentioned PSA to update Consultant's planning staff and hourly rates; and WHEREAS, on October 7, 2014, the County and Consultant executed Amendment No. 3 to the PSA to substitute Consultant's name from Van Ness Feldman GordonDerr to Van Ness Feldman, LLP; and WHEREAS, Exhibit "B" to the above-mentioned PSA is amended to update Consultant's planning staff references, and NOW, THEREFORE, it is hereby agreed as follows: That Exhibit "B" to the original Professional Services Agreement is amended to in regard to Consultant's planning staff references and hourly rates, and is attached hereto.
