K11 I7'A5 COI NT
May 11, 2018
Mr. Chris Horner
KIr=xWA9% COUNTY
DEPARTMENT OF PUBLIC WORKS
Mark R. Cook, PE Director
Deputy Prosecuting Attorney
205 West 5th Avenue, Suite 213
Ellensburg, WA 98926
RE: Kittitas County Claim for Damages Number 201804120025
Ryan Wales
Dear Mr. Horner:
Public Works has reviewed the claim for damages submitted by Mr. Ryan Wales (04/12/2018
date stamp) and assigned number 201804120025. The results of our internal review of the claim
are listed below for your consideration.
• During the period of time referenced in the claim, Public Works was conducting ditch
cleaning operations in Grassland Plat.
• The material produced from the cleaning operation did not include the type of material
listed in the claim (airborne light and overloaded).
• Two other yellow dump trucks were seen in the area during the same day of the claim.
• Our surplus dump truck will typically leave the paint outline of our old logo when we
prepare them for surplus.
Our maintenance supervisor (Mr. Jim Van de Venter) maintains it was more likely than not the
farm dump trucks and not Public Works dump trucks that were the offenders in this claim. We
take Gaze not to overload our dump trucks with material that can be airborne — owing to previous
claims against us. Public Works cannot definitely state that the offending trucks were surplus
County trucks. The claim specifically states: "Myself and Sam Eillinger identified the dump
truck with the County logo on it". We are concerned that our trucks become easy targets when
mistaken for surplus vehicles. Given the fact pattern in this claim, Public Works recommends
denial.
Sincerely,
Mark R. Cook
Director
C: Mr. Jim Van de Venter, Maintenance Manager
411 N.
