<br />STATE OF WASHINGTON <br /> <br /> <br /> <br />DEPARTMENT OF ECOLOGY <br /> <br /> <br /> <br />UNION GAP, WA <br /> <br /> <br /> <br />NOTICE OF APPLICATION TO ENTER A DIVIDED PORTION OF YAKIMA ADJUDICATION COURT CLAIM NO. 00535 (WATER RIGHT B, S4-85296-J) INTO THE STATE TRUST WATER RIGHT PROGRAM: <br /> <br /> <br /> <br />TAKE NOTICE: <br /> <br /> <br /> <br />That on March 5, 2018, Kittitas County of Kittitas County, WA filed application number CS4-00535sb9 with the Department of Ecology to enter Water Right B of Court Claim No. 00535 into <br />the state’s Trust Water Rights Program. This will include a change in purpose of use and place of use. <br /> <br /> <br /> <br />That said right, under priority date of June 30, 1901, authorizes the diversion of 2.175 cubic feet per second and 706.061 acre-feet per year from Spring Creek at two points of diversion: <br />POD No. 1 being 1400 feet south and 125 feet east from the northwest corner of Section 30 and being within Government Lot 2 (SW¼NW¼) of Section 30; AND, POD No. 2 being 100 feet south <br />and 550 feet east from the west quarter corner of Section 30 and being within Government Lot 3 (NW¼SW¼) of Section 30, both within T. 17 N., R. 19 E.W.M. <br /> <br /> <br /> <br />That said right authorizes water to be used for irrigation of 39.87 acres from April 1 through October 15 within Lot 2 of the PAPINEAU SHORT PLAT, SP-17-00001, records of Kittitas County; <br />being a portion of the W½ SW¼ of Section 30, T. 17 N., R. 19 E.W.M. lying northerly of Ringer Road and southwesterly of the Northern Pacific Railway Company right of way. <br /> <br /> <br /> <br />That the applicant proposes to change the purpose of use to year-round instream flow and mitigation, and change the place of use to Spring Creek and the Yakima River. <br /> <br /> <br /> <br />Protests or objections to approval of this application must include a detailed statement of the basis for objections. All letters of protest will become public record. Cash shall not <br />be accepted. Fees must be paid by check or money order and are nonrefundable.
