�� �pSUocS-_ro>HEro MB <br />F <br />I(ITTITA$ COUM1TY <br />KIWW=AAB COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC HEARING <br />DIRECTOR'S/ENGINEER'S REPORT <br />PROPOSED VACATION OF PERRY ROAD <br />Zirkle Fruit desires to acquire more access points than County Code permits to facilitate their fruit operations. <br />Public Works controls access points on Public Roads, by vacating portions of Perry Road Zirkle Fruit Company <br />would have the ability to control their access needs along the private road portion better suiting their operational <br />need. Due to ownership of land solely controlled by Zirkle Fruit along Perry Road no impacts would occur to <br />other County residents. Easements would be maintained for utilities to serve Zirkle operations. <br />Background: <br />1. Perry Road has existed under county ownership without formal documentation. Under RCW 36.75.070 <br />and RCW 36.75.080, the County may establish right of way on roads maintained at the public expense <br />for 7 years or more. The county has maintenance documents on Perry road dating back to 1967. <br />2. As the exact turnaround location is yet to be determined and agreed upon, an exact acreage cannot be <br />determined; however, from conversations between the County Engineer and the vacation applicants, <br />the proposed location of the turnaround would result in a total vacation area of approximately 3.7 <br />Acres. <br />3. The entire area in question is zoned CA— (Commercial Agriculture). There are no adjacent properties <br />with a different zoning. The nearest area with a different zoning is 1000 feet to the North of the <br />proposed Vacation, and is zoned AG20-(Agriculture 20). <br />4. As the applicants own both sides of the roadway as a single parcel, the vacation procedure results in a <br />single vacation, with no need to divide the right of way to individual owners or parcels. As there is <br />physical proof of underground utilities in the right of way, the right of way upon vacation should be <br />replaced with a coincident public utility easement to allow the continued use and maintenance of said <br />utilities. <br />5. The adjoining property for the proposed vacation falls entirely to a single parcel and single ownership, <br />the details of which are as follows: <br />Parcel ID: 390433 <br />Map No.: 17-19-33010-0015 <br />Owner Name: Moe, Eric S etux and Nisbet, Peter B and Molly B. <br />6. The road vacation fee of $4,205 was paid in full on May 12, 2017. <br />7. We have maintenance documents maintaining Perry Road as a primitive road back to 1967. Currently <br />Perry Road is maintained as a paved roadway. <br />8. Previously multiple residential and agricultural accesses utilized Perry Road. Currently Zirkle Fruit <br />Company controls all access points off of Perry Road South of the KRD irrigation canal and the <br />proposed vacation limit.
