PUBLIC HEARING STAFF REPORT
HEARING DATE: February 6, 2018
ACTION REQUESTED: Conduct a Public Hearing to consider the vacation of
a portion of Perry Road right of way.
BACKGROUND: On October 2, 2017, Kittitas County Public Works
received a request from Phil Hull, authorized agent for
petitioners: Zirkle Fuit Company, to vacate a portion
of Perry Road, to accommodate a growing agricultural
operation along Perry Road.
Kittitas County Code allows for one access off of a
County Road per parcel with an optional second
access for agricultural purpose. The operational need
along the Southern half of Perry Road has required
Zirkle Fruit to look at options to have and maintain
several access points, truck turn arounds, staging, and
loading areas for fruit production.
Zirkle Fruit is the sole owner of all land South of the
Kittitas Reclamation District canal along Perry Road.
This prompted Public Works to recommend Zirkle
Fruit to submit a road vacation application allowing
them to control operation along this portion of Perry
Road to better accommodate their operation and
alleviate the public road requirements that were
hindering their needs.
Perry Road no longer services multiple landowners
south of the aforementioned canal rendering the need
for a public road inapplicable.
Public Works recommends considering the vacation as
the public will be benefited by its vacation and
abandonment due to the reduction in maintenance and
lack of public interest due to the change of land
ownership and surrounding agricultural operations.
Subject to Zirkle Fruit Company providing acceptable
lands for constructing an end of road turnaround post
vacation.
And subject to Zirkle Fruit Company providing a
public utility easement coincident with the vacated
right of way to allow continued service of existing
utilities.

of way subject to the creation of a public utility
easement coincident with the vacated lands, and
suitable lands dedicated to the public for turnaround
at end of road.

RESOLUTION NO. 2018 -
TO AUTHORIZE THE VACATION OF A PORTION OF PERRY ROAD
WHEREAS: On January 2, 2018, the Board of County Commissioners set a hearing
date to consider the proposed vacation of a portion of Perry road right-of-
way; and
WHEREAS: The Notice of Hearing was conducted in accordance with Kittitas County
Code 12.22 Vacation of County Roads; and
WHEREAS: Said hearing was held on February 6, 2018 at 2:00 pm by the Board of
County Commissioners; and
WHEREAS: The Board determined theses portions of road right of way do not benefit
the county road system; and
WHEREAS: The Board determined the public will be benefited by vacating the
portions of road right of way as a result of all served parcels now falling
under the ownership of a single large scale agricultural operation; and
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in
the best interest of the public, and after careful consideration of the facts,
testimony and evidence presented at said hearing does hereby declare the
vacation of that portion of Perry Road, subject to the receipt of suitable
lands to allow for constructing a turn -around the new end of county road.
