ACTION REQUESTED:
Request to execute Agreement for Kittitas County Superior Court Indigent Defense Services with Brumley
and Hull, PLLC.
BACKGROUND:
At least since 1989 indigent defense in the Kittitas County Superior Court has been provided by willing
attorneys volunteering to have their names placed upon a list off of which the Court appoints attorneys.
Under this system the Court has compensated the attorneys on a per-case basis, with additional funding
being available for time spent in trial, and for complex or abnormally time-consuming cases. In 2018 the
Court is moving to contract attorneys as already implemented in the Lower and Upper Kittitas County
District Courts. Contracts will be provided to individual attorneys and law firms. The contracts provide
how many cases will be completed by each attorney and the rate of pay thereon. This gives the attorney
certainty in workload and compensation, and guarantees to the court that an attorney will be available for the
contract term.
