AGENDA STAFF REPORT
AGENDA DATE: February 6, 2018
ACTION REQUESTED: Deny Claim of Suzanne Rector.
BACKGROUND: The claimant, Suzanne Rector (“Ms. Rector”), claims damages of
approximately $4499.15, for personal injuries sustained at the county
fairgrounds (Bloom Pavillion) as a result of her horse stepping on her
leg on September 3, 2017. Kittitas County Claim # 201712290016.
INTERACTION: The incident alleged in the Claim occurred during the Kittitas County
Fair. Ms. Rector claims a pig “spooked the horse” which knocked her
down and stepped on her leg and foot. Witnesses also suggest there
were trucks in the area that might have also agitated the horse.
Regardless, Ms. Rector signed a waiver releasing Kittitas County for
any damages suffered during the event. Additionally, RCW 4.24.540
protects Kittitas County from liability for equine activities, which are
an inherently risky activity. Staff recommends denial of this claim.
RECOMMENDATION: Deny Kittitas County Claim # 201712290016.
