KITTITAS COUNTY <br />PROSECUTING ATTORNEY’S OFFICE <br /> <br />AGENDA STAFF REPORT <br /> <br /> <br />AGENDA DATE: January 19, 2011 <br /> <br />ACTION REQUESTED: No action re Dissolution of TV District. <br /> <br /> <br /> <br />BACKGROUND: In the January 4, 2011 Agenda, the matter was set over to allow the <br />TV district time to resolve its affairs. <br /> <br /> <br />INTERACTION: As of January 13, 2011, I have heard of no completed steps by the <br />tv district. The TV District is waiting for final word from the office overseeing the <br />federal grant. The federal grant contract manager appears to have no problems with <br />another party taking over the grant so long as the intention to use the equipment in the <br />same way remains the same, but the federal legal staff still needs to complete review. <br />Mr. Eaton sent a letter regarding allowing the lease to be taken over by the Yakima LLC, <br />however, what is needed is a letter regarding transferring the lease to any party who bids <br />highest (as the county cannot guarantee that the Yakima LLC will win the bid) and <br />removal of the automatic lease termination clause (or the lease will terminate as soon as <br />the TV district is dissolved, leaving the equipment stranded). There has been no word <br />regarding the TV district’s forgiveness of all outstanding taxes. There has been no word <br />regarding transferring a copy of all TV District documents, records and meeting minutes to the <br />County. <br /> <br /> <br />RECOMMENDATION: No action re dissolution of TV District until the above four <br />items are completed. <br /> <br /> <br />LEAD STAFF: Suzanne Becker, Deputy Prosecuting Attorney
