Kittitas County <br />Auditor <br /> <br />Agenda Staff Report <br /> <br />AGENDA DATE: <br />10/5/2010 <br /> <br />ACTION REQUESTED: <br />Request the Board to approve the changes to the Homelessness Fund Guidelines referring to monies <br />awarded from that fund that are used to purchase or improve property that will be used to meet homeless <br />needs in our county will be subject to the 25 year period requirement <br /> <br />BACKGROUND: <br />Based upon the research done by the Prosecuting Attorney the guidelines to the Homelessness Fund <br />referring to monies awarded from that fund that are used to purchase or improve property that will be used <br />to meet homeless needs in our county will be subject to the 25 year period requirement. Agencies using the <br />funds only to provide services for homeless individuals are not subject to the 25 year period. <br /> <br />If the recipient of ESSHB 2163 homeless assistance surcharge funds fails to meet the objectives and <br />requirements of the homeless assistance housing law and fails to serve the homeless community in accord <br />with the intent and requirements of RCW 36.22.179 and RCW 43.185C.070 for at least a period of twenty- <br />five years, then the money provided by the County shall be repaid to the County with interest at the <br />maximum legal rate in existence at the time the grant funds are paid to the recipient. Upon application to the <br />Review Committee, and upon approval by the Board of Kittitas County Commissioners, new housing <br />projects shall have this restriction placed on the deed.
