Dear Dan:
MAR
Wildcat Estates LCC was submitted and it appeared there was no water problem. Tiger
Estates LLC was submitted later and that triggered DOE saying that a water right was
necessary.
Subsequently, I wrote to Melissa Downes of DOE on 10/22/08 (letter enclosed). Since
she never responded, I called her in November. She said she would review my letter with
her supervisor and they would get back to me. I have heard nothing.
In early January, I submitted Ms. Downes's 10/22/08 letter to Holly Duncan. Holly said
she would see what she could do to supply water for Wildcat and Tiger plats. Several
weeks later, she replied by phone that I would need to deal with DOE. On February 24,
2009, I wrote to Holly and asked her what the approval of Eagles Landing Short Plat and
Aztec Estates Plat meant in terms of water approved (see letter enclosed). To date I have
never heard anything definitive from her.
I am frustrated so I am appealing to you for some direction and help. Since the Mission
View Group B well is approved for six connections that should take care of the water
needs for Eagles Landing Short Plat. There are four existing connections to the Group B
well and there are three vacant lots in Eagles Landing. Lot D does not need water as that
lot is used as part of my house's property. That leaves lots A and B as future
connections. Mission View Well has been in the name of Mission View Well Users
Association since July of 1999 when the association opened a banking account at Sterling
Bank in Ellensburg. That well belongs to the members of Mission View Well Users
Association.
Aztec Estates Plat was approved for individual wells on 7 lots. One of the 7 (lot G) has
an existing well on it.
Wildcat Estates LLC Plat and Tiger Estates LLC Plat have 8 and 7 lots respectively.
Dave Nelson, as my registered agent, mistakenly submitted Wildcat before Tiger,
contrary to my instructions.
My question on a possible strategy: If we withdraw Wildcat Estates LLC and move
forward on only Tiger Estates LLC, will this likely satisfy DOE and Kittitas County in
their contention that I need a water right? Given the sequence of submittals mentioned in
paragraph 1 above, it appears that would be likely. If this is potentially a doable strategy,
06
I am willing to go that way. I do want to be sure that Wildcat Estates LLC remains
vested with Ag. 3 zoning. I, as did others, moved to subdivide the lands in question
because the county repeatedly said that the Ag. 3 lands had to be vested or there was
danger of that status being lost. I will not develop any of the plats in question. I am
simply trying to complete some estate planning.
What is your reaction? If you want to meet with me on this, let me know.
Sincerely,
William 'dt

Dear Ms. Downes:
I am responding to your October 10, 2008 letters to Ms_ Mackenzie Moynihan regarding
the Wildcat Estates LLC (LP -08-24) and Tiger Estates, LLC (LP -08-22) SEPA review
documents. You state that the proposals (LP -08-24, LP -08-22, P-07-09, and SP -07-33)
are related. You indicate the combined proposals will result in a total of *29 lots and will
require a water right. (*The number 29 should be 25. See RS at end of letter.)
My response to this statement is in two parts:
1. My wife and I are the owners of SP -07-33 (Eagles Landing) and P-07-09
(Aztec Estates). LP -08-24 (Wildcat Estates) and LP -08-22 (Tiger Estates) are
LLC's of which my wife, Melva M. Schmidt, is the manager. These four
parcels will not be served by "wells drilled by the same person or groups of
persons, at or about the sarne time, in the same area, for the same purpose or
project... " My wife and I will not develop any of these subdivisions during
our lifetimes. They will all have separate owners if and when they are
developed. It is highly unlikely they will ever be developed at the same time
and they will not be for the same purpose or project_ The properties involved
were a long-time investment by us. We are not developers. Beginning about
thirty years ago, we purchased these properties with the intent to subdivide
this marginal farmland into home sites.
2. Let me address the situation of each of these plats regarding water availability.
a. E@gles Landing Sh rt Plat SP -07-33 was approved by Kittitas
County as four lots to be served by Group B Mission View Well
#05361R. That well was approved for 6 connections and its use was
approved for this plat. Four connections are in use, leaving two
connections for the three remaining lots in Eagles Landing. I chose to
not provide a connection for Lot D because it will probably never be a
home site.
b. Tiger Estates Plat (LP -08 22}22} consists of 7 lots. My proposal in the
SEPA document for that plat is to seek approval to add these lots to
Group B Mission View Well #053618 An employee of the Kittitas
County Public Health Department suggested that to me. Again, that
well is approved for 6 connections and with 7 additional lots; it would
serve 13 connections (within the limit for Group B wells).
c. Aztec Estates Plat (P-07-09) was approved by Kittitas County as 7 lots
to be served by individual wells. One of the lots (G) has an existing
Neil. The same Kittitas County Public Health Department employee
gold me that. if needed. I could apply for approval of that existing well
::s a Uroup B well. 1 will reserve that as an option.
d. Wildcat Estates LLC (LP -08-04) is an 8 -lot plat and the intent is to put
individual wells on each lot
Analysis
With Eagles Landing and Tiger Plat planned for well service from Group B Mission
View Well #05361R, that leaves Wildcat Estates with'9 lots and Aztec Estates with 6 or 7
lots (6 if I don't count the lot with the existing well). Using the 5,000 gallons per day
limitation on exempt wells for the 14 or IS lots of Wildcat Estates and Aztec Estates, that
would make available 357.15 gallons per day for each of 14 lots and 333.33 gallons per
day for each of 15 lots. As all of these lots will be served by Kittitas Reclamation
District for irrigation water, the above amounts would be adequate to serve 14 or 15
homes in the two plats. T have operated Group B Mission View Well 405361R for nearly
ten years and my records indicate that amount of water is adequate for each connection.
My covenants prohibit the use of well water for irrigation purposes.
By my analysis, it is my feeling that the 5,000 -gallon per day limit will handle the water

Dear Holly:
I received your phone message regarding my plats' water situation while I was in
southern Utah several weeks ago. You indicated that I would need to work with Ecology
on my securing water for my pending Wildcat and Tiger plats.
I have had Aztec Estates Plat (SP -07-09) approved for 7 lots with individual wells.
Eagles Landing Short Plat (SP-07-33was also approved using the existing Group B well
(Mission View #05361R) as the source of water for two lots. That would mean that that
well would then have six connections, the current approved maximum. That would
handle the water needs of Eagles Landing Short Plat.
Before I begin to further discuss this water situation with Ecology, would you verify in
writing that the previous above paragraph is correct? I need to have a baseline as what
was approved for water when Aztec Estates Plat and Eagles Landing Short Plat were
approved.
I would appreciate a prompt reply, as I want to move forward on this matter. I want to do
some soil logs, but I want the water situation clarified before I do that.
Sincerely,
William D. Schmidt

Dear Ms. Moynihan:
On the SEPA application for Tiger Preliminary Plat (LP -08-22) on page 2, item 7, there
is the question: "Do you have any plans for future additions, expansion, or further activity
related to or connected with this proposal7" Tiger Estates LLC, responded: "No this is a
stand-alone development. It will be transferred to another party at a future date." You
wrote in these notations: "Adjacent to Wildcat Plat, Game Farm View Plat, Fairview
Crest, Dakota View, etc."
First, Wildcat Plat is a LLC separate from Tiger Plat (also a LLC) and the two will not be
developed as one larger development. In fact, before any development commences, each
LCC will have separate and different owners.
Second, Game Farm View Plat, Fairview Crest, and Dakota View are under a separate
ownership with no connection either with Tiger or Wildcat Plats and any development
activities will be completely separate.
Third, not mentioned was the Timothy Short Plat, which adjoins Wildcat Plat on the east.
These two plats are under completely separate ownership and also will not be developed
as a larger development. Some employees of the Kittitas County Health Department
expressed to Andrew J. Schmidt (owner of Timothy Short Plat) that there was some kind
of connection between Timothy Short Plat and Wildcat Plat. There is none. The former
owners of the land that now comprises Wildcat Estates LLC, William D. and Melva M.
Schmidt, sold their interest in the Timothy Short Plat land to Andrew J. and Michell
Schmidt. As a part of the sale tmnsaction, a lane easement from Timothy Short Plat to
Wildcat Plat was traded for a small parcel of land on the east end of Wildcat Plat. This
was done to make both parcels more workable. There is no other connection between the
two plats and they will be developed completely independent of each other.

Dear Ms. Downes:
I am responding to your October I0, 2008 letters to Ms_ Mackenzie Moynihan regarding
the Wildcat Estates LLC (LP -08-24) and Tiger Estates, LLC (LP -08-22) SEPA review
documents. You state that the proposals (LP -08-24, LP -08-22, P-07-09, and SP -07-33)
are related. You indicate the combined proposals will result in a total of *29 lots and will
require a water right. (*The number 29 should be 25. See P.S. at end ofletter.)
n
My response to this statement is in two parts:
1. My wife and T are the owners of SP -07-33 (Eagles Landing) and P-07-09
(Aztec Estates). LP -08-24 (Wildcat Estates) and LP -08-22 (Tiger Estates) are
LLC's of which my wife, Melva M. Schmidt, is the manager. These four
parcels will not be served by `wells drilled by the same person or groups of
persons, at or about the same time, in the same area, for the same purpose or
project... " My wife and I will not develop any of these subdivisions during
our lifetimes. They will all have separate owners if and when they are
developed. It is highly unlikely they will ever be developed at the same time
and they will not be for the same purpose or project. The properties involved
were a long-time investment by us. We are not developers. Beginning about
thirty years ago, we purchased these properties with the intent to subdivide
this marginal farmland into home sites.
2. Let me address the situation of each of these plats regarding water availability.
a. Eagles LandingShort hort Plat(SP-07-33) was approved by Kittitas
County as four lots to be served by Group B Mission View Well
#05361R. That well was approved for 6 connections and its use was
approved for this plat. Four connections are in use, leaving two
connections for the three remaining lots in Eagles Landing_ I chose to
not provide a connection for Lot D because it will probably never be a
home site.
b. Tiger Estates Plat (LP -08-22) consists of 7 lots. My proposal in the
SEPA document for that plat is to seek approval to add these lots to
Group B Mission View Well #05361R. An employee of the Kittitas
C6
well. The same Kittitas County Public Health Department employee
told me that, if needed, I could apply for approval of that existing well
as a Group B well. I will reserve that as an option.
d. Wildcat Estates LLC (LP -08-04) is an 8 -lot plat and the intent is to put
individual wells on each lot.
Analysis
With Eagles Landing and Tiger Plat planned for well service from Group B Mission.
View Well #05361 R, that leaves Wildcat Estates with 8 lots and Aztec Estates with 6 or 7
lots (6 if I don't count the lot with the existing well). Using the 5,000 gallons per day
limitation on exempt wells for the 14 or 15 lots of Wildcat Estates and Aztec Estates, that
would make available 357.15 gallons per day for each of 14 lots and 333.33 gallons per
day for each of 15 lots. As all of these lots will be served by Kittitas Reclamation
District for irrigation water, the above amounts would be adequate to serve 14 or 15
homes in the two plats. I have operated Group B Mission View Well #05361R for nearly
ten years and my records indicate that amount of water is adequate for each connection.
My covenants prohibit the use of well water for irrigation purposes.
By my analysis, it is my feeling that the 5,000 -gallon per day limit will handle the water
needs of Aztec Estates and Wildcat Estates Plats. Eagles Landing and Tiger Plats are
programmed for connection to Group B Mission View Well #05261 R to meet their water
needs. Therefore, I see no reason for requiring a water right. I look forward to your
evaluation of my plans and observations.

I have reviewed the Application for the Tiger Preliminary Plat (LP -08-22). I provide fire code
review for Kittitas County Fire District Two. The Fire District has no fire code authority for this
area so the following is for information purposes only. During development, the following issues
will need to be addressed:
1. The addresses need to be clearly visible from both directions at the county road for all
properties.
2. The fire department access road needs to capable of supporting 75,000lbs in all weather,
be 20' wide, provide 13'6" vertical clearance and provide for adequate turn -around for
fire department apparatus in accordance with IFC 2006 -- Appendix D if applicable.
Thank you for your time and consideration in these matters.

Thank you for the opportunity to comment during the optional determination of non -significance
process for the Tiger Preliminary Plat division of approximately 21.06 acres into 7 lots, proposed
by Tiger Estates, LLC [LP 08-22]. Ecology provided comments in a letter dated October 1,
2008, however we overlooked some information during our review and we would Iike to provide
the following revised comments:
Water Resources
The following Water Resource comments are to supersede comments sent in Ecology's SEPA
letter(s) dated June 25, 2008 and October 1, 2008.
Ecology believes this proposal, LP 08-22, and proposals P 07-09 & SP 07-33, LP -08-24 are
related. The combined proposals will result in a total of 29 lots and will require a water right.
Any ground water withdrawals in excess of 5,000 gallons per day or for the irrigation of more
than % acre of lawn or noncommercial garden will require a permit from the Department of
Ecology.
Chapter 173-150 WAC provides for the protection of existing rights against impainnent, i.e.
interruption or interference in the availability of water. If water supply in your area becomes
limited your use could be curtailed by those with senior water rights.
The Attorney General's Opinion, (AGO 1997 No. 6) regarding the status of exempt ground water
withdrawals, states that a group of wells drilled by the same person or group of persons, at or
about the same time, in the same area, for the same purpose or project should be considered a
single withdrawal and would not be exempt from the permitting requirement contained in
RCW 90.44.050, if the total amount withdrawn for domestic use exceeds 5,000 gallons per day
or if a total of more than 0.5 acre of lawn and garden are irrigated.
Ms. Mackenzie Moynihan
October 10, 2008
Page 2
The Attorney General's opinion suggests that caution should be used in finding developments to
be exempt from needing a water right permit if the possibility exists that the development of the
project will result in the ultimate withdrawal of water in excess of 5,000 gallons per day or the
irrigation of more than 0.5 acre of lawn and garden.

Water Resources
The following Water Resource comments are to supersede comments sent in Ecology's SEPA

The water purveyor is responsible for ensuring that the proposed use(s) are within the limitations
of its water rights. If the proposal's actions are different than the existing water right (source,

As the 5,000 gallons per day ground water exemption is not intended as a means to circumvent

Dear Ms. Moynihan:
Thank you for the opportunity to comment on the short plat of approximately 21.06 acres
into 7 lots, proposed by Tiger Estates LLC [LP -08-22]. We have reviewed the
application and have the following comments.
Water Quality
Proiect Greater -Than 1 Acre with Potential to Discharge Off -Site
An NPDES Construction Stormwater General Permit from the Washington State
Department of Ecology is required if there is a potential for stormwater discharge from a
construction site with more than one acre of disturbed ground. This permit requires that
the SEPA checklist fully disclose anticipated activities including building, road
construction and utility placements. Obtaining a permit is a minimum of a 3 8 day
process and may take up to 60 days if the original SEPA does not disclose all proposed
activities.
The permit requires that Stormwater Pollution Prevention Plan (Erosion Sediment
Control Plan) is prepared and implemented for all permitted construction sites. These
control measures must be able to prevent soil from being carried into surface water (this
includes storm drains) by stormwater runoff. Permit coverage and erosion control
measures must be in place prior to any clearing, grading or construction.
More information on the stormwater program may be found on Ecology's stormwater
website at: http://www.ecy•wa•gov/programs/wg/storTnwater/construction/ . Please
submit an application or contact Bryan Neet at the Dept. of Ecology, (5 09) 575-2808,
with questions about this permit.

Dear Mackenzie:
Thank you for the opportunity to comment on Tiger Preliminary Plat #fLP-08-22.
Any ground water development proposal that will withdraw water in excess of 5,000 gallons
per day for single or group domestic supply (the limit for exempt well water withdrawal), or
for the irrigation of more than 1/2 acre of lawn or non-commercial garden will require a permit
from the Department of Ecology. On March 28, 2002 the Washington State Supreme Court
ruled that the permit exemption of RCW 90.44.050 does not apply "where a developer of a
residential subdivision proposes multiple wells that will individually serve each Iot in the
development" which in combination exceed the exemption criteria. If such a permit does not
exist for this development I recommend that this plat utilize a Group B water system to
serve the 7 lots. A well site inspection must be performed to approve the site where the
well is. The group B workbook and all associated paperwork must be turned in and the
system design approved prior to final plat approval.
Soil logs are required for each lot where installation of a septic system is intended
I look forward to assisting you if you have further questions or concerns.
Sincerely,,.

Thank you for the opportunity to comment during the determination of non -significance
process for the Tiger Preliminary Plat #LP -08-22.
New information regarding the water use on this project has been addressed by the State of
Washington Department of Ecology (Ecology), requiring a water right to proceed. Because
Kittitas County Public Health requires proof of an adequate water supply in order to approve
any subdivision, the applicant is responsible for coordinating with Ecology to prove adequate
water is available for the project. Approval of the water right and the public system must
be submitted prior to approval by Kittitas County Public Health.
As was stated in our previous comment letter soil logs are required for each lot where
installation of a septic system is intended
I look forward to assisting you if you have further questions or concerns.
