BACKGROUND: The claimants, Teresa Ann Sloan (“Ms. Sloan”) and James Foode (“Mr. Foode”) claim damages of $1207.21 to repair the “front left quarter panel” of their vehicle, as a result of damage allegedly caused by the road gate at the county airport. Ms. Sloan and Mr. Foode claim the gate’s safety devices had been disabled, possibly by an act of vandalism. Kittitas County Claim # 201708160073. INTERACTION: Public Works admits the gate at the airport was partially damaged at the time of the incident alleged in the claim. However, when the gate was examined later, there did not appear to be any damage to the edge of the gate, which suggests the gate actually worked correctly, meaning the gate closed on the vehicle and reversed according to design specifications. Furthermore, it appears Ms. Sloan’s own actions appear to have contributed to the damage to her vehicle in that she stopped/abandoned her vehicle in the midst of a gate cycle. A car would have to be parked in the gate opening for at least 20 seconds before the gate would start to close. Public Works recommends partial approval of this claim. RECOMMENDATION: Partially Approve Kittitas County Claim # 201708160073, in an amount not to exceed $603.61, subject to receipt of a signed Release of All Claims. HANDLING: Original – Clerk of the Board Copy – Auditor Copy – Prosecutor ATTACHMENTS: Public Works’ Findings/Recommendation LEAD STAFF: Christopher Horner, Deputy Prosecuting Attorney Mark Cook, Public Works Director
