KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS AGENDA STAFF REPORT AGENDA DATE: May 16th, 2017 ACTION REQUESTED: Approve a resolution authorizing payment of $54,995 to CRAB for previously reimbursed design funds for Westside Road RAP project #1915-02 BACKGROUND: Kittitas County received RAP funding from CRAB for the Westside Road Safety Improvement project. This project has previously gone through two scope changes and funding reallocations which resulted in Public Works reimbursing CRAB approximately $55K for design efforts in 2014 that were no longer applicable to the project scope. Public works was able to avoid repayment of approximately $55K in design funds to CRAB with the understanding that the design generated with these funds would be applicable towards the current scope of the project. After review of the scope and authorized CRAB funds of approximately $875,000 to complete the previously estimated project at $1,140,000, Public Works determined this was not feasible. Estimates for the proposed work represented a cost of approximately $3,500,000. Public Works and the BOCC did not feel it was in the best interest of the County to fund the difference with the existing road fund reserves. Resolution 2017-028 was adopted requesting to turn back funds to CRAB in the amount of $1,026,000. A formal waiver of payback for the previous design expenditures was not requested. We did however informally request that the CRAB board consider allowing Kittitas County to avoid repayment based on the possibility of a future design having the ability to utilize the design efforts previously conducted. The Department of Public Works received a letter from CRAB requiring the County to return the remaining $54,995.00 by June 26th, 2017 per WAC 136-167-030 (1) based on the previously agreed upon
