BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF ICIT'TI'TAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO. 2017 - <br />(DECLARATION OF EMERGENCY — AUDITORS OFFICE ASBESTOS <br />REMOVAL <br />WHEREAS: the Kittitas County Maintenance Department has reported to the Board of County <br />Commissioners that an on-going remodeling project in the Office of the Kittitas County <br />Auditor has resulted in the inadvertent and unexpected discovery of asbestos in some of <br />the construction; and <br />WHEREAS: the presence of asbestos and the risk of disturbance thereof in the course of the project <br />presents a significant threat to the safety of employees and citizens; and <br />WHEREAS: the project is stalled until that asbestos is properly removed and disposed of in a safe and <br />lawful manner, which requires compliance with strict standards for such work; and <br />WHEREAS: the working conditions of the Auditor's staff are substantially and negatively impacted by <br />the inability to complete the remodeling; and <br />WHEREAS: the Auditor's Office has statutory duties that are not discretionary; and <br />WHEREAS: due to those duties, the Auditor's Office must remain open for business to the same <br />extent as if the remodeling project were not in progress; and <br />WHEREAS: the only manner by which the remodeling project is able to be continued and the <br />Auditor's Office is able to be open during its normal hours is to complete the asbestos <br />removal and disposal on the coming weekend, and <br />WHEREAS: declaring a state of emergency, by which the Maintenance Department is able to obtain <br />the services of a contractor qualified to safely and lawfully remove and dispose of the <br />asbestos is necessary for restoration to a condition of usefulness of this public property. <br />Justification falls under RCW 36.40.180 — restoration of public property the usefulness of <br />which has been destroyed by accident, and RCW 36.32.270 and RCW 39.04.280 which <br />allow for competitive bids to be waived in the event of the emergency. <br />RESOLVED: That it is hereby declared that there has been an emergency due to the <br />above described circumstances, and that the Board of County Commissioners and <br />
