BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS COUNTY <br />STATE OF WASHINGTON <br /> <br />RESOLUTION NO.________________ <br /> <br />Resolution Authorizing Reimbursement from the Ryegrass Balefill <br />Post-Closure Reserve for Documented Post-Closure Costs <br /> <br />WHEREAS: The Kittitas County Board of Commissioners is responsible for managing the countywide <br />Solid Waste System under chapter 70A.205 RCW, chapter 36.58 RCW, and the Joint Solid Waste <br />Disposal System Agreement of March 12, 1979; and <br /> <br />WHEREAS: The Ryegrass Balefill Landfill is a closed municipal solid waste landfill subject to <br />continuing post-closure monitoring, maintenance, reporting, and financial assurance requirements under <br />chapter 173-351 WAC and Agreed Order No. DE98-SW-C168; and <br /> <br />WHEREAS: RCW 70A.205.165 requires financial assurance adequate to cover landfill closure costs, <br />including post-closure monitoring, pollution prevention measures, and other procedures required by state <br />and federal regulations; and <br /> <br />WHEREAS: WAC 173-351-600 requires continuous financial assurance for the costs of post-closure <br />care and permits a municipal corporation to maintain that assurance through cash and investments <br />accumulated in a reserve fund restricted for post-closure care; and <br /> <br />WHEREAS: Kittitas County has maintained funds restricted for Ryegrass Balefill Landfill post-closure <br />obligations while also paying eligible post-closure monitoring, reporting, testing, financial assurance <br />support, and related compliance costs from Solid Waste operating revenues; and <br /> <br />WHEREAS: Parametrix completed a cost allocation review dated August 12, 2026, <br />which identified $387,209.89 in supportable Ryegrass Balefill Landfill post-closure costs paid by the <br />County based on records reviewed to date; an <br /> <br />WHEREAS: The Board finds that reimbursing the Solid Waste operating fund for those documented <br />expenditures is an appropriate use of the Ryegrass Balefill post-closure reserve, provided that the <br />reimbursement is limited to eligible post-closure costs and that the remaining financial assurance <br />continues to satisfy applicable law, the approved post-closure plan, and permit requirements; <br /> <br />NOW THEREFORE BE IT RESOLVED: The Board of County Commissioners authorizes reimbursement <br />to the appropriate Solid Waste operating fund from funds designated for Ryegrass Balefill Landfill post - <br />closure care, as documented in the Parametrix memorandum dated August 12, 2026. <br /> <br />BE IT FURTHER RESOLVED: The Solid Waste Director is authorized to take the necessary <br />administrative and accounting actions to carry out this resolution in accordance with applicable County <br />requirements. <br /> <br />Dated this _____ day of September, 2026 <br /> BOARD OF COUNTY COMMISSIONERS <br /> KITTITAS COUNTY WASHINGTON <br /> <br /> <br /> ____________________________________ <br /> Brett Wachsmith, Chairman <br /> <br />
