KITTITAS COUNTY
COMMUNITY DEVELOPMENT SERVICES

AGENDA ITEM STAFF REPORT

AGENDA DATE: August 4th, 2026

TOPIC: Public Hearing to extend the moratorium regarding Kittitas County Code Chapter 17.13 (Transfer of Development Rights) for six (6) months, which includes a work plan

ACTION REQUESTED: Request to approve Resolution.

BACKGROUND: Washington State Department of Commerce, in its March 27th and May 22nd, 2026 comment letter on the County’s 60-day notice of intent to amend development regulations, strongly recommended that Kittitas County amend or rescind its current TDR program because implementation guidelines are ambiguous and misapplication may have the opposite effect of the program’s intent, which is encouraging growth in rural areas rather than directing it toward cities and Urban Growth Areas consistent with the Growth Management Act.

The Board enacted an emergency moratorium for six (6) months on any new Transfer of Development Rights applications by Resolution 2026-101, as authorized by RCW 36.70A.390, on June 8th, 2026.

RCW 36.70A.390 also requires that a hearing be held within 60 days. CDS is proposing to the Board of County Commissioners consider extending the moratorium for six (6) months with the work plan as presented in Exhibit A, as it’s necessary, reasonable, to protect the public health, safety, and welfare of Kittitas County.

INTERACTION: Kittitas County Community Development Services Department (CDS).

RECOMMENDATION: Approve Resolution with Exhibits extending the moratorium for six (6) months.

ATTACHMENTS: Resolution & Associated Exhibits

LEAD STAFF: Chad Bala, Director

EXHIBIT 1:

Community Development Services “Staff Report”, 2026
