Authority Under RCW 8.08.010 <br />for the Acquisition of Right of Way and a <br />Temporary Construction Easement for Flood <br />Mitigation on Whiskey Creek, RE Parcel Numbers <br />962710 and 962712. <br />BACKGROUND: The Whiskey Creek at Ellensburg Water Company <br />Siphon Project is identified in the Flood Control <br />Zone District Capital Improvement Plan. This <br />project aims to reduce flooding impacts from <br />Whiskey Creek at Bender Road and the Ellensburg <br />Water Company (EWC) canal crossing by <br />increasing flood conveyance capacity along <br />Whiskey Creek. <br />INTERACTION: <br />The project requires a temporary construction <br />easement for 24,501 square feet of property on <br />parcels 962710 and 962712, as well as a right-of- <br />way acquisition for 9,230 square feet on parcel <br />962710. The right-of-way acquisition is necessary <br />for the flood mitigation siphon project to ensure that <br />the Ellensburg Water Company retains its current <br />ability to conduct operational spills at this location. <br />Kittitas County has submitted two written offers to <br />the property owner but has not been able to reach a <br />voluntary agreement. <br />Public Works; Prosecuting Attorney <br />RECOMMENDATION: Set a Public Hearing on October 21, 2025, at 2:00 <br />pm local time to consider the Exercise of <br />Condemnation Authority Under RCW 8.08.010 for <br />the Acquisition of Right of Way and a Temporary <br />Construction Easement for Flood Mitigation on <br />Whiskey Creek, RE Parcel Numbers 962710 and <br />962712. <br />
