KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />STAFF REPORT FOR PUBLIC HEARING <br /> <br />DATE: April 16, 2024 <br /> <br />ACTION REQUESTED: Discuss an Ordinance Amending Chapter 15.08 KCC, <br />governing Kittitas County’s regulation of burn bans, to <br />correct minor internal inconsistencies. <br /> <br />BACKGROUND: An inconsistency was brought to the attention of the <br />Prosecuting Attorney’s Office by the Sheriff’s Office. In <br />reviewing this section of the code, a minor inconsistency <br />was noticed. As currently written, KCC 15.08.030 does not <br />include language to account for the State’s statutory <br />assessments that are added on top of the County’s listed <br />fine when a case/citation is added into the State’s Court <br />system. This needs to be present to ensure that personnel <br />issuing citations provide the correct total on the citation. <br />This area has been changed to add the language “not <br />including statutory assessment.” In reviewing this section <br />of the code the PAO has reviewed the entirety of KCC <br />15.08 and has determined that there are no other <br />inconsistencies contained within this section of the code. <br /> <br />INTERACTION: Staff members from the PAO are working on the County <br />code to correct errors and inconsistencies brought to its <br />attention as well as those that it finds on its own. <br /> <br />RECOMMENDATION: Set a public hearing to discuss adoption of the proposed <br />ordinance. <br /> <br /> <br />ATTACHMENT: Draft Ordinance with proposed amendments to the <br />code. <br /> <br />LEAD STAFF: Douglas R.
