BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />R E S O L U T I O N <br /> <br />NO. ___________ <br /> <br />APPROVING CONDITION 25 REMAND FOR SUPERIOR COURT REGARDING THE <br />FINAL PLAT OF FOREST RIDGE PHASE 4 AND 5 <br /> <br />WHEREAS: In September 2023, Superior Court remanded to staff Condition 25 of the Final <br />Plat of Forest Ridge Phase 4 and 5; and <br /> <br />WHEREAS: Legal representatives for the plat proponent are working to resolve an access <br />easement with an area resident to preserve the primary access as depicted on the <br />face of the plat; and <br /> <br />WHEREAS: Staff have worked with the proponent’s engineer developing an alternative <br />access that satisfies the Condition 25 remand from Superior Court; and <br /> <br />WHEREAS: The County Engineer has vetted the proposed alternative access for <br />acceptability satisfying the Condition 25 Superior Court remand. <br /> <br />NOW, THEREFORE BE IT RESOLVED: The Board of County Commissioners, after due <br />consideration, does hereby affirm the Final Plat of Forest Ridge Phase 4 and 5 by accepting the <br />County Engineer’s alternative access analysis for the final plat. <br /> <br />DATED this 6th day of February 2024, at Ellensburg, Washington. <br /> <br /> <br /> BOARD OF COUNTY COMMISSIONERS <br /> KITTITAS COUNTY, WASHINGTON <br /> <br /> <br /> ________________________________ <br /> Brett Wachsmith, Chairman <br />Attest: <br /> <br />☐ Clerk of the Board- Julie Kjorsvik ______________________________ <br />Laura Osiadacz, Vice-Chairman <br /> <br />☐ Deputy Clerk of the Board- Mandy Buchholz <br /> _______________________________ _______________________________ <br /> Cory Wright, Commissioner <br />
