BOARD OF' COUNTY COMMISSIONERS <br />COI]NTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />No.2o23- fl 59 <br />RATIF'YING THE CHAIR OF'COUNTY COMMISSIONERS SIGNATURE ON THE WATER <br />RIGIITS PURCHASE AND SALE AGREEMENT FOR WATER RIGHT CERTIF'ICATE NO. S4- <br />84269-J Ai\D AUTHORIZING CHAIR SIGNATT]RE ON CLOSING DOCUMENTS <br />WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State <br />Department of Ecology (WDOE) as administered by the Public Works Department; and <br />WHEREAS: On March 13,2023, the Kittitas County Board of Commissioners entered into a Purchase <br />and Sale Agreement with David W. Adams, LeAnn T. Adams William S. Craig, and <br />Constance M. Craig to purchase the consumptive and non-consumptive portions of the <br />Water Right with a priority date of June 30, 1871, and assigned Certificate No. 54-84269- <br />J; and <br />WIIERf,AS: The Purchase and Sale Agreement identifies several contingencies that need to be satisfied <br />to close the transaction; and <br />WHEREAS: One identified contingency is for the Kittitas County Board of Commissioners to pass a <br />resolution in the ordinary course of its business ratifuing the Purchase and Sale <br />Agreement. <br />NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas County, <br />Washington, in the best interest of the public, does hereby ratif,z the Chair signature on the water rights <br />purchase and sale agreement for Water Right Certificate No. S4-84269-J. <br />BE IT FIIRTHER Rf,SOLVED, once all contingencies in the Purchase and Sale Agreement have been <br />met, the Chair of the Kittitas County Board of Commissioners is authorized to execute any further <br />documents, on behalf of Kittitas county, necessary to close the transaction. <br />DATED this 4th day of April 2023, atEllensburg, Washington. <br />BOARD OF COUNTY COMMISSIONERS <br />Cory Wright, <br />o+ <br />Julie Kjorsvik <br />/l| llll\Vice-Chairman <br />ABSENT <br />tr Deputy Clerk of the Board- Mandy Buchholz <br />Laura Osiadacz, Comm issioner
