BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />Resolution No. 2023___________ <br /> <br />A RESOLUTION AUTHORIZING AN AMENDMENT OF THE MERRILL LEASE <br />EXECUTED DECEMBER 21, 2021 TO REFLECT THE CORRECT LEGAL <br />DESCRIPTION AND ANNUAL LEASE PRICE OF THE REAL PROPERTY LEASED <br />AT THE BOWERS FIELD AIRPORT <br /> <br />WHEREAS: Kittitas County Code (KCC) 2.81.060(4) requires that all leases of real property be <br />approved by the Board of County Commissioners (Board); and <br /> <br />WHEREAS: The Board of County Commissioners and Mark and Linda Merrill previously <br />executed a lease on December 21, 2021, for the lease or real property located at the Bowers Field <br />Airport; and <br /> <br />WHEREAS: The legal description of the real property listed in the lease was incorrect; and <br /> <br />WHEREAS: The Parties desire to amend the lease to reflect the correct legally identified piece <br />of real property at the Bowers Field Airport; and <br /> <br />WHEREAS: The amendment correctly reflects this legal description of the property as lot H- <br />24; and <br /> <br />WHEREAS: the size of lot H-15B is 6,960 square feet and the size of lot H-24 7,480 square <br />feet; and <br />WHEREAS: the annual rent for the lease will change from $1,113.60 to $1,254 per year based <br />on the increased space leased; and <br />WHEREAS: the parties wish to correct that error such that the Tenant’s lease is for lot H-24 for <br />the annual rent of $1,254.00. <br /> <br />NOW, THEREFORE, BE IT RESOLVED: <br /> <br />The Board of County Commissioners hereby authorizes the execution of the lease amendment <br />attached hereto and incorporated herein by this reference. <br /> <br />ADOPTED this _____ day _________ 2023. <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br /> <br /> <br />__________________________________ <br />Chairman
