BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION NO. 2022 - <br />RESOLUTION APPROVING SALE OF RETIRED KCSO FIREARMS <br />WHEREAS, The Board of County Commissioners has the authority to make such <br />contracts as may be necessary to their corporate or administrative powers, and to do all necessary <br />acts in relation to the property of the County pursuant to RCW 36.010, and <br />WHEREAS, The County's powers can only be exercised by The Board of County <br />Commissioners or by agents or officers acting under their authority or other authority of law <br />pursuant to RCW 36.01.030; and <br />WHEREAS, The Board of County Commissioners has previously adopted Kittitas County <br />Code Chapter 2.81 "Management of County Real and Personal Property" as authorized by RCW <br />36.34.005; and <br />WHEREAS, the Kittitas County Sheriff has determined that certain firearms owned by his <br />Office should be retired and replaced, and such list is attached herein; and <br />WHEREAS, KCC 2.81.080(5) allows for the sale of retired duty weapons to Sheriff's <br />deputies; and <br />WHEREAS, certain Sheriff's deputies have expressed a desire to purchase a retired duty <br />weapon; and <br />WHEREAS, due to the amendment of Washington law by Initiative 594 such purchases <br />require that the purchaser complete a background check as conducted by a licensed firearms <br />dealer; <br />NOW THEREFORE, BE IT HEREBY RESOLVED that the Board of County <br />Commissioners of Kittitas County, Washington authorizes the Sheriff of Kittitas County in such <br />cases in which a deputy has expressed a desire to purchase the firearm in question to transfer <br />such retired firearms to the licensed dealer of the Sheriff's choice to allow the deputy the <br />opportunity to purchase said firearm at fair market value, which shall be the same as the trade-in <br />value given for the same make and model firearms not made available to the deputies. All funds <br />resulting from the sale of such firearms, less that portion retained by the dealer in the same <br />manner as in any other transaction, shall be used by the Sheriff as directed by KCC 2.81.080(4). <br />DATED this day of <br />RESOLUTION <br />2022. <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />Chairman <br />
