COMMISSIONERS’ MINUTES <br />KITTITAS COUNTY, WASHINGTON <br />WEBEX <br />REGULAR MEETING <br />HR STUDY SESSION <br /> <br />TUESDAY 10:00 AM 12/08/2020 <br /> <br />Board members present: Brett Wachsmith, Laura Osiadacz, Cory Wright <br />Others: Patti Johnson, Benjamin West, Christopher Horner, Lisa Young, Jeanne Killgore <br /> <br />CALL TO ORDER <br />The meeting was called to order at 10:00 AM. <br />DISCUSSION – CONSIDER AMENDMENT TO COUNTY CODE – INDEMNIFICATION OF COUNTY OFFICERS, <br />EMPLOYEES, AND VOLUNTEERS <br />Deputy Prosecutor Horner summarized that the Prosecutor’s Office would like to start a discussion to <br />adopt an indemnification policy. He explained that the current statute is vague and allows for Counties <br />to create their own detailed and favorably worded policy. Commissioner Wright asked how the <br />proposed process would be initiated, and what would happen if there was a disagreement between the <br />Board and the Prosecutor’s Office. DPA Horner answered that the process would begin when an <br />employee is sued and requests legal assistance from the County. The Board would then decide to <br />approve or deny the request. If a disagreement arose in the decision-making process, the Board would <br />typically have final authority. Commissioner Wright commented that the term “volunteer” in the draft <br />policy is very broad and asked if that was the intent of the policy. DPA Horner responded that the term <br />“volunteer” is included in the statute and therefore included in the proposed policy. He stated that the <br />County is responsible for anyone who does any work for the County. The Board approved moving <br />forward was the indemnification policy. DPA Horner will work with BOCC and Prosecutor staff to <br />schedule a public hearing. <br />EXECUTIVE SESSION – RCW 42.30.140(4)(B) THAT PORTION OF A MEETING DURING WHICH THE <br />GOVERNING BODY IS PLANNING OR ADOPTING THE STRATEGY OR POSITION TO BE TAKEN BY THE <br />GOVERNING BODY DURING THE COURSE OF ANY COLLECTIVE BARGAINING, PROFESSIONAL <br />NEGOTIATIONS, OR GRIEVANCE OR MEDIATION PROCEEDINGS, OR REVIEWING THE PROPOSALS <br />MADE IN THE NEGOTIATIONS OR PROCEEDINGS WHILE IN PROGRESS. <br />The Board entered executive session at 10:11 AM to discuss union negotiations with an anticipated <br />length of ten minutes. Anticipated action: none. The Board exited executive session at 10:22 AM. No <br />action taken.
