BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />RESOLUTION NO. <br />Development Agreement by and between Kittitas County <br />and <br />Easton Ridge Land Company, Inc. <br />�C 04 2019 <br />�rL 4 - <br />THIS DEVELOPMENT AGREEMENT ("Development Agreement") is entered into and <br />effective this day of , 2019, by and between Kittitas County, a <br />political subdivision of the State of Washington ("County") and Easton Ridge Land Company, <br />Inc., a corporation organized under the laws of the State of Washington ("Developer"). This <br />Agreement is made pursuant to Revised Code of Washington ("RCW") 36.70B.170 and Kittitas <br />County Code ("KCC") Chapter 15A.11. <br />RECITALS <br />1. KCC 15A.I I authorizes the execution of a development agreement between the County <br />and a person having ownership or control of real property within its jurisdiction. <br />2. This Development Agreement by and between Kittitas County and the Developer relates <br />to the development to be known as "Marian Meadows Estates" (or simply, the <br />"Project"). <br />3. The Developer owns certain real property (the "Property") consisting of 445.42 acres <br />across 17 parcels, located approximately seven miles northwest of Roslyn in portions <br />of Sections 1 and 12, Township 20, Range 13 E, WM in Kittitas County, bearing <br />Assessor's map numbers 20-13-01000-0012, 20-13-12000-0013, 20-13-01000-0004, <br />20-13-01000-0013, 20-13-01051-0018, 20-13-01051-0014, 20-13-01051-0015, 20- <br />13-01051-0013, 20-13-01051-0012, 20-13-01051-0008, 20-13-01051-0007, 20-13- <br />01051-0006, 20-13-01051-0002, 20-13-01051-0001, 20-13-01051-0016, 20-13- <br />01000-0011, 20-13-01051-0017. <br />4. On May 1, 2018, the Board of County Commissioners approved Ordinance 2018-006, <br />granting the Marian Meadows Planned Unit Development (PD -17-00001), <br />Conditional Use Permit (CU -17-00001), and Plat (LP -17-00001) for the Developer to <br />pursue the Project at the site above. <br />5. KCC 15A.11.020(2) requires a development agreement to set forth the standards and <br />other provisions that shall apply to, govern and vest the development, use and <br />mitigation of the development of real property for the duration specified in the <br />agreement. <br />Development Agreement — Page 1 of 12 <br />
