09/25/2017 MINUTES 1 <br />COMMISSIONERS' MINUTES <br />KITTITAS COUNTY, WASHINGTON <br />COMMISSIONERS AUDITORIUM <br />SPECIAL MEETING <br /> <br />MONDAY 4:00 P.M. SEPTEMBER 25, 2017 <br /> <br />Board members present: Chairman Paul Jewell; Vice-Chairman Laura <br />Osiadacz; and Commissioner Obie O’Brien. <br /> <br />Others: Holly Myers, Environmental Health Supervisor; Peter Dykstra, <br />Special Deputy Prosecuting Attorney and 5 members of the public. <br /> <br />PUBLIC HEARING SCHNEBLY WATER RIGHTS COMMISSIONERS <br /> <br />At 4:00 p.m. CHAIRMAN JEWELL opened a Public Hearing to consider the <br />purchase of Water Rights from Craig & Nancy Schnebly. <br /> <br />PETER DYKSTRA, SPECIAL DEPUTY PROSECUTING ATTORNEY provided a <br />history and reviewed the documents which had been prepared relating <br />to the purchase of the Schnebly Water Rights including a Resolution; <br />Agreement to Lease Water for Irrigation; Option Agreement for <br />Package B Mitigation Certificates; and a Second Amendment to Water <br />Right Purchase and Sale Agreement. He said the proposed closing date <br />is October 1, 2017. The proposed purchase is for 563.961 acre-feet <br />of consumptive use water at a price of $4,632.45 per acre-foot of <br />consumptive use water, for a grand total of $2,612,521.13. <br /> <br />PAUL DEMPSEY, REPRESENTING THE SCHNEBLY’S spoke in favor of the <br />proposed purchase. <br /> <br />THERE BEING NO ONE REQUESTING TO TESTIFY, THE PUBLIC PORTION OF THE <br />HEARING WAS CLOSED. <br /> <br />RESOLUTION 2017-158 SCHNEBLY WATER RIGHTS COMMISSIONERS <br /> <br />COMMISSIONER OSIADACZ moved to approve Resolution No. 2017-158, <br />correcting the document to reflect the final purchase amount of <br />$2,612,521.13. COMMISSIONER O’BRIEN seconded. <br /> <br />COMMISSIONER OSIADACZ noted how the purchase & sale has been in the <br />works for a very long time and that she respected the amount of time <br />& effort that went into getting to this point. She also expressed <br />her appreciation to the Schnebly’s for their patience. COMMISSIONER <br />O’BRIEN also thanked the Schnebly’s because without people like them <br />they would not be able to have an answer to the water needs within <br />the County. <br /> <br />CHAIRMAN JEWELL thanked the Public Health Staff; Mr. Dykstra; Mr. <br />Clarke; and the Schnebly’s for their hard work, patience and
