BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />RESOLUTION <br />NO. 2018-_______ <br /> <br />RESOLUTION AUTHORIZING USE OF THE CUMULATIVE RESERVE FUND FOR <br />DRUG ENFORCEMENT ACTIVITIES BY KITTITAS COUNTY PUBLIC HEALTH <br />DEPARTMENT <br /> <br />WHEREAS, Kittitas County, through the Kittitas County Public Health Department (KCPHD) <br />is charged with the preservation, promotion, and improvement of health in the <br />County; and <br />WHEREAS, on December 21, 2017 KCPHD was alerted by law enforcement that the residence <br />located at 311 N. Wright Avenue, Cle Elum, Washington was contaminated with <br />potentially hazardous materials including but not limited to unknown powders in <br />connection with the manufacture of illicit drugs; and <br />WHEREAS, pursuant to Chapter 64.44 RCW, a health order was issued for the property <br />prohibiting access and requiring sampling and decontamination by a Washington <br />State Department of Health certified agency; and <br />WHEREAS, based on the reliable information from multiple federal agencies that had <br />legitimate concerns that fentanyl may be one of the contaminants in the home, <br />efforts to contract for sampling and decontamination were delayed until the <br />Washington State Crime Lab reports were finalized; and <br />WHEREAS, Washington State Crime Lab reports were received and reviewed in April 2018; <br />and <br />WHEREAS, KCPHD made multiple attempts to enforce compliance of the health order with the <br />homeowner and/or the home owner’s power of attorney since the homeowner is <br />currently incarcerated out of state; and <br />WHEREAS, the attempts to seek homeowner compliance with the health order were <br />unsuccessful and KCPHD had no choice but to ensure proper sampling of the <br />property; and <br />WHEREAS, KCPHD contracted with ACCUMETH, an authorized contractor, to perform the <br />the preassament required under the health order and Chapter 64.44 RCW at a cost <br />of $4,770.00; and <br /> <br />WHEREAS, in addition to the costs expended for the preassment report, KCPHD expended <br /> $1500.00 in costs directly related to enforcing the health order; and <br /> <br />WHEREAS, the costs incurred for the preassment report and health order enforcement were the <br /> direct result of KCPHD’s statutory compliance with Chapter 64.44 RCW; and <br />
