KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />AGENDA STAFF REPORT <br />AGENDA DATE: October 16, 2018 <br />ACTION REQUESTED: Approve & Sign Addendum to Lease for Leroy <br />Miller, d/b/a Miller Refrigeration <br />BACKGROUND: On October 1, 2008, Leroy Miller, d/b/a Miller <br />Refrigeration entered into a lease for County land <br />located at the Bowers Field Airport within the <br />Industrial Area. <br />INTERACTION: <br />RECOMMENDATION <br />HANDLING: <br />ATTACHMENTS: <br />LEAD STAFF: <br />Per RCW 36.34.180 the county is required to <br />renegotiate these long-term leases every 5 years. <br />As of October 1, 2018, this lease is up for <br />renegotiation. The term of the lease has been <br />extended for another five (5) years at the request of <br />the Lessee and will expire in 2023. <br />The lease rate reflects a 1.24% increase and will go <br />from $.066 per square foot to $.067 for a total dollar <br />increase of $9.74 per year. <br />The Consumer Price Index was used to determine <br />the rate of increase. <br />At the direction of the Board of County <br />Commissioners the Addendum also adds the <br />Modification or Termination clause. Recently, the <br />Federal Aviation Administration noticed staff that a <br />Nondiscrimination clause was to be added to all <br />leases as well due to funding requirements and is <br />included in the Addendum. <br />Public Works, Miller Refrigeration <br />Approve & Sign Addendum to Lease <br />Return 1 original to Public Works <br />Lease Addendum; Original Lease <br />Mark R.
