BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION APPROVING SHERIFF'S AUTHORITY TO ENTER INTO EXTRA <br />DUTY EMPLOYMENT CONTRACTS FOR DEPUTY SHERIFFS <br />RESOLUTION No. 2017-I as <br />WHEREAS, The Board of County Commissioners has the authority to make such <br />contracts as may be necessary to their corporate or administrative powers, and to do all necessary <br />acts in relation to the property of the County pursuant to RCW 36.01.010, and <br />WHEREAS, The County's powers can only be exercised by The Board of County <br />Commissioners or by agents or officers acting under their authority or other authority of law <br />pursuant to RCW 36.01.030; and <br />WHEREAS, The Board of County Commissioners has previously delegated to the <br />Kittitas County Sheriff specific authority regarding the Board's duty to negotiate, enter into, and <br />approve contracts for various contractual obligations with a value of less than $10,000 dollars as <br />allowed by law; and <br />WHEREAS, The Board of County Commissioners has requested that a process be <br />implemented by which Deputy Sheriffs may be hired for such extra duty as may be consistent <br />with the professional judgment of the Sheriff in order to protect lives and property and keep the <br />peace by enforcing the law consistent with the policies of the Sheriff; and <br />WHEREAS, a similar delegation of authority is appropriate to the operational needs of <br />the County and the Sheriff by allowing the Sheriff to apply that professional judgment with <br />regard to such extra duty employment; and <br />WHEREAS, the provisions of Resolution 2009-22 pertaining to the procedures for <br />review of contracts by the Kittitas County Prosecutor's Office have been followed with regard to <br />implementation of the policy and contract for services for such extra duty; and <br />WHEREAS, the cost of doing so in a manner consistent with the County's obligations <br />pursuant to law and the relevant Collective Bargaining Agreement with regard to the cost of and <br />payment to the County and its employees for such services has been determined; <br />NOW THEREFORE, BE IT HEREBY RESOLVED that the Board of County <br />Commissioners of Kittitas County, Washington authorizes the Sheriff of Kittitas County to <br />negotiate, enter into, and approve contracts for extra duty Deputy Sheriff employment with a <br />value ofless than $10,000 dollars.
