Ruby St., Suite 2, Ellensburg, WA 98926 <br />CDS@CO.KITTITAS.WA.US <br />Office (509) 962-7506 <br />Fax (509) 962-7682 <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: April 17, 2018 <br /> <br />ACTION REQUESTED: Approve the Second Amendment to the Development Agreement for Palomino <br />Fields Plat to correct scrivener errors and provide clarification to lot <br />configuration and public and private roads. <br /> <br /> <br />BACKGROUND: On June 7, 2016 the Kittitas County Board of County Commissioners (BOCC) <br />approved the Development Agreement for Palomino Fields Plat (DA-15-00001) <br />with Resolution 2016-073 to allow for phasing of the development. On May 2, <br />2017 the BOCC approved an amendment to the Development Agreement for <br />Palomino Fields Plat (DA) revising the phasing plan to allow for flexibility to <br />maximize site soil conditions addressing treatment and disposal of improved site <br />stormwater runoff with Resolution 2017-081. After recording of the amended <br />DA, it was discovered that a number of scrivener errors existed in the document <br />and that clarification was necessary regarding lot configurations and public and <br />private road standards to ensure consistency with the previous approvals for the <br />Palomino Fields Plat (Res. No. 2008-160, Res. No. 206-073, and Res. No. 2017- <br />081). <br /> <br />On March 29, 2018 Chad Bala, authorized agent for Cle Elum Pines East LLC <br />and Cle Elum Pines West LLC request amendments to the DA. Community <br />Development Services has reviewed the request and after discussion with the <br />County’s prosecuting attorney, agrees that there is a need to address the scrivener <br />errors and provide clarification to the DA approved by Resolution 2017-081. A <br />redline version of this second amendment to the DA is provided for your review. <br />Additionally, a clean version is provided for BOCC Chair signature upon <br />approval if granted. The prosecuting attorney advised these corrections can be <br />considered on the consent agenda and do not require a public hearing. <br /> <br />INTERACTION: Community Development Services, Prosecuting Attorney, and Board of County <br />Commissioners <br /> <br />RECOMMENDATION: Approve the Second Amendment to the Development Agreement for Palomino <br />Fields Plat and direct the Chairman of the Board to sign the DA. <br /> <br />ATTACHMENTS: Redline version of proposed Development Agreement, Clean Copy of proposed <br />Development Agreement, and Resolution for signature <br /> <br />LEAD STAFF: Lindsey Ozbolt, Planning Official
