Kittitas County <br />Public Health Department <br /> <br />Agenda Staff Report <br /> <br /> <br /> <br />AGENDA DATE: <br />September 1, 2026 <br /> <br />ACTION REQUESTED: <br />The Board of County Commissioners approves a joint BOCC/BOH Public Hearing on September <br />17, 2026, at 10:00am to consider revisions to Kittitas County Code Chapter 13.40. <br /> <br />BACKGROUND: <br />Under the current provisions of KCC 13.40.010(a)(iii), applicants utilizing mitigation certificates <br />through the County’s water mitigation program are required to submit a residential building <br />permit application within two years of mitigation certificate issuance. <br />Applicants pursuing development that relies on a Group B public water system must complete <br />substantial planning, engineering, and regulatory coordination for water system approval prior <br />to submitting for construction permits. This has created situations wh ere applicants end up <br />with expired mitigation certificates and must reapply, despite development progress already <br />established through the Group B review and approval process. <br />The proposed amendment to KCC 13.40.010(a)(iii) would allow applicants to satisfy mitigation <br />certificate timelines through submission of either a residential building permit application or a <br />Group B public water system application within two years of mitigation certificate issuance. <br /> <br />INTERACTION: <br />Public Works, Public Health, and the Prosecutor’s Office have worked together to bring the <br />proposed amendment to the Board. <br /> <br />RECOMMENDATION: <br />The Board of County Commissioners approves a joint BOCC/BOH Public Hearing on September <br />17, 2026, at 10:00am to consider revisions to Kittitas County Code Chapter 13.40. <br /> <br />HANDLING: <br />N/A <br /> <br />LEAD STAFF: <br />Arden Thomas <br /> <br />
