KITTITAS COUNTY <br />COMMUNITY DEVELOPMENT SERVICES <br />AGENDA ITEM STAFF REPORT <br />AGENDA DATE: July 21T% 2026 <br />ACTION REQUESTED: Request to Set a Public Hearing for August 4t', 2026, at 2:00 pm for <br />the Board of County Commissioners to consider extending the <br />moratorium regarding Kittitas County Code Chapter 17.13 for one <br />(1) year. <br />BACKGROUND: Washington State Department of Commerce, in its May 22, 2026 <br />comment letter on the County's 60-day notice of intent to amend <br />development regulations, strongly recommended that Kittitas <br />County amend or rescind its current TDR program because <br />implementation guidelines are ambiguous and misapplication may <br />have the opposite effect of the program's intent, which is <br />encouraging growth in rural areas rather than directing it toward <br />cities and Urban Growth Areas consistent with the Growth <br />Management Act. <br />The Board enacted an emergency moratorium for six (6) months on <br />any new Transfer of Development Rights applications by Resolution <br />2026-101, as authorized by RCW 36.70A.390 on June 81, 2026. <br />RCW 36.70A.390 also requires that a hearing be held within 60 days <br />whether or not the governing body receives a recommendation on <br />the matter from the planning commission or department. CDS staff <br />is requesting a public hearing for August 4a', 2026, at 2:00 p.m. for <br />the Board of County Commissioners to consider extending the <br />moratorium for one (1) year is necessary, reasonable, and narrowly <br />tailored to protect the public health, safety, and welfare. <br />A staff report, resolution, and workplan will be provided prior to the <br />public hearing. <br />RECOMMENDATION: Set a Public Hearing for August 4th, 2026, at 2:00 pm to Consider <br />extending the moratorium for one (1) year and Resolution. <br />HANDLING: Return one Notice of Public Hearing to Community Development <br />Services. <br />ATTACHMENTS: Notice of Public Hearing <br />LEAD STAFF: Chad Bala, Director <br />
