BOARD OF' COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />No.2024- 005 <br />AUTHORIZING THE CHAIR'S SIGNATTJRE ON WATER RIGHT QUIT CLAIM DEED ANI) <br />REAL ESTATE EXCISE TAX (REET) AFF'IDAVIT <br />WHEREAS: The purchase of Water Right S4-83598-J from Solar Dollar LLC was authorized by <br />Resolution 2022-1 40; and <br />WHEREAS: Resolution2023-169 authorized Kittitas County to accept funding from the Department of <br />Ecology for the purchase of Water Right 54-83598-J; and <br />WHEREAS: Kittitas County entered into funding agreement WRWBP-2123-KiCPWD-00010; and <br />WHEREAS: On November 28, 2023,the Washington Depaftment of Ecology issued Water Right <br />change determination CS4-83598-J, authorizing the change of use to instream flow and <br />mitigation; and <br />WHEREAS: On December2l,2023,Solar Dollar LLC conveyed Water Right S4-83598-J, as modified <br />by the Washington State Department of Ecology Water Right Change Application No. <br />CS4-83598-J to Kittitas County via Special Warranty Deed; and <br />WHEREAS: Kittitas County, as required to manage the water right in the State Trust Water Rights <br />Program for water banking purposes and by funding agreement WRWBP-2123-KiCPWD- <br />00010, now desires to convey this water right via Quit Claim Deed and Real Estate Excise <br />Tax (REET) Affidavit to Ecology; <br />NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas County, <br />Washington, in the best interest of the public, does hereby approve the Chair's signature <br />on the Water Right Quit Claim Deed and Real Estate Excise Tax Affidavit. <br />DA 2nd day of January, 2024, at Ellensburg, Washington. <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COLINTY, WA TON <br />tr Clerk of the Board- Julie Kjorsvik <br />6"puty Clerk of the Board- Mandy Buchholz
