BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />RESOLUTION No. 2024-_______ <br />EASEMENT AGREEMENT WITH D&N DEVELPOMENT FOR EMERGENCY EXIT <br />AND UTILITY CONNECTION <br /> <br />WHEREAS: Kittitas County is constructing a new Kittitas County Lower County <br />Transfer Station; and <br /> <br />WHEREAS: The City of Ellensburg Fire Marshal is requiring an emergency exit on the <br />northwest corner of the property and this easement will meet the <br />requirement of the Fire Marshal and; <br /> <br />WHEREAS: The City of Ellensburg is also requiring the water line loop from Green <br />Ave back to Highway 97 in the Northwest corner of the site; and <br /> <br />WHEREAS: The Neighboring property owner (D&N Development) is currently <br />developing their site and has agreed to grant the county an easement to use <br />their road for the emergency exit and connect to the waterline at our <br />property line to complete the loop; and <br /> <br />WHEREAS: The cost for the easement is approximately equal to the amount it would <br />cost the Solid Waste Department to construct the exit and water line <br />connection; and <br /> <br />NOW THEREFORE, BE IT HEREBY RESOLVED: that the Board of County <br />Commissioners, in the best interest of the public, does hereby agree to <br />enter into an easement agreement with D&N Development in perpetuity <br />for the amount of $200,000. <br /> <br />ADOPTED this day of 2024. <br /> BOARD OF COUNTY COMMISSIONERS <br /> KITTITAS COUNTY, WASHINGTON <br /> <br /> _________________________________________ <br /> Brett Wachsmith, Chair <br /> <br /> _________________________________________ <br /> Laura Osiadacz, Vice-Chairman
