BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF'KITTITAS <br />STATE OF'WASHINGTON <br />RESOLUTION <br />No.: 2024 -l3l r <br />A RESOLUTION ACCEPTING THE KROGER CO. MULTI STATE <br />SETTLEMENT AGREEMENT <br />WHEREAS' since July 201 8, Kittitas County has been a party to litigation against <br />opioid manufacturers, distributors, and pharmacies, Kroger Co., and its <br />subdivisions and affiliates (collectively "Kroger"), fo. the wrongful <br />production, promotion, and distribution of prescription opioid drugs and <br />the damage they have caused in Kiffitas County; and <br />WHEREAS, a settlement (the *2024 Settlement Agreement") has been negotiated by <br />the State of Washington (the "State") with Krogero and Kittitas County, as <br />party to the litigation (as a "Litigating Subdivision"), ffidy opt-in to the <br />2024 Settlement Agreement, the details of which appear at the following <br />link: Kroeer Co. Settlement - National Opioids Settlement <br />(nationalopioidsettlement.corn) ; and <br />WHEREAS, the County may opt into the settlements reached with Kroger and if all 37 <br />local litigation governments participate in the settlement, as they did for <br />the prior opioid settlements, cities and counties as a whole will receive <br />$24 million payable over l1 years; and <br />WHEREAS, on April 5, 2022,the Board of County Commissioners (the "Board") <br />entered into the One Washington Memorandum of Understanding <br />Between Washington Municipalities (One WA MOU) agreeing to the <br />allocation and use of settlement proceeds resulting from opioid litigation, <br />and the County's allocation amount agreed to in the One WA MOU, <br />namely: 0.3855704683 percent; and <br />WHEREAS' the settlement amount received by the County is to be used for "Opioid <br />Remediation" as that term is defined in the 2024 Multi-State Settlement <br />Agreement including care, treatment, and other programs and expenditures <br />designed to (1) address the misuse and abuse of opioid products, (2) treat <br />or mitigate opioid use or related disorders, or (3) mitigate other alleged <br />effects of the opioid abuse crisis, including on those injured as a result of <br />the opioid abuse crisis; and <br />Page I of3
