KITTITAS COUNTY
BOARD OF COUNTY COMMISSIONERS
AGENDA STAFF REPORT

AGENDA DATE: July 2, 2024

ACTION REQUESTED: Request to approve a Resolution Annexing “Horse Jump
Road Annexation” into Kittitas County Fire Protection
District No. 7.

BACKGROUND: On June 10, 2024, the Kittitas County Board of
Commissioners Office received a letter from Auditor Bryan
Elliott, along with a Certificate of Sufficiency; map of the
area to be annexed; a copy of RCW 52.04.011; Kittitas
County Fire District No. 7 Resolution 2024-8 – Accepting
Annexation Petition & Approving Annexation; and a full
legal description of the parcel numbers to be included in the
annexation. RCW 52.04.011(3) allows for the county
legislative authority to enter its order incorporating the
territory into the existing fire protection district. According
to the Auditor’s Certificate of Sufficiency, there are
sufficient signatures of registered voters as required by
RCW 52.04.011(1). There are 21 voters within the area, 14
petitions were submitted within the area, and a total of 14
signatures of qualified electors were verified, exceeding the
required amount to meet sufficiency. The Certificate of
Sufficiency was issued for 67%, which is at least 60% of
the qualified registered voters who signed the petition.

INTERACTION: The Prosecutor’s office has reviewed the materials, as well
as the draft Resolution to be considered by the Board of
County Commissioners (#10764). According to DPA
Doug Mitchell, there is no public hearing needed by the
Board of County Commissioner pursuant to the statute. He
also noted, "the county legislative authority or authorities
of the county or counties within which such territory is
located have the authority and duty to determine on an
equitable basis, the amount of any obligation which the
territory to be annexed to the district shall assume to place
the property owners of the existing district on a fair and
equitable relationship with the property owners of the
territory to be annexed as a result of the benefits of
annexing to a district previously supported by the property
owners of the existing district." RCW 52.05.011(2).
