KITTITAS COUNTY <br />SHERIFF'S OFFICE <br />AGENDA STAFF REPORT <br />AGENDA DATE: November 1, 2022 <br />ACTION REQUESTED: Request to Acknowledge the Addendum to the LESO <br />Program State Plan of Operation (SPO) between the State of Washington and Kittitas <br />County Sheriff's Office. <br />BACKGROUND: The LESO (Law Enforcement Support Office) State Plan of <br />Operation (SPO) sets forth terms and conditions with respect to excess Department of <br />Defense personal property transferred pursuant to 10 USC Section 2576a to promote the <br />efficient and expeditious transfer of property and to ensure accountability of the same. <br />The Secretary of Defense is authorized by 10 USC § 2576a to transfer to Federal and <br />State/Territory Law Enforcement Agencies (LEAs), personal property that is excess to <br />the needs of the DoD, including small arms and ammunition, that the Secretary <br />determines is suitable to be used by such agencies in law enforcement activities, with <br />preferences for counter-drug/counter-terrorism or border, disaster -related emergency <br />preparedness or border security activities, under such terms prescribed by the Secretary. <br />The Secretary of Defense has delegated authority for management of this program to the <br />DLA. DLA defines law enforcement activities as activities performed by governmental <br />agencies whose primary function is the enforcement of applicable Federal, <br />State/Territory, and local laws and whose compensated law enforcement officers have <br />powers of arrest and apprehension. <br />The SPO Addendum implements requirements found within Presidential Executive Order <br />(EO) 14074 (Section 12), signed on May 25, 2022. It adds specific items to their <br />"controlled" property definitions. For our agency, this most notably affects the terms <br />under which our MRAP (Mine -Resistant Ambush Protected) vehicle can be used. <br />INTERACTION: This agreement was reviewed and approved by the Kittitas County <br />Prosecutor's Office. <br />RECOMMENDATION: Acknowledge the Addendum to the LESO Program State Plan <br />of Operation (SPO) between the State of Washington and Kittitas County Sheriff's <br />Office. <br />HANDLING: None. <br />LEAD STAFF: Command Staff <br />
