KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: June 16, 2020 <br /> <br />ACTION REQUESTED: Approve Resolution to Execute a Revised Interlocal for <br />CARES Funding Allocation and Execute Revised <br />Interlocal. Rescind Original Interlocal. <br /> <br />BACKGROUND: In order to apply for the variance to enter phase 2 of the <br />reopen Washington Plan, Kittitas County was required to <br />submit a plan detailing our capabilities regarding testing, <br />quarantine and isolation, case investigation and contract <br />tracing, data management, tracking, and other related <br />tasks, which all require funding. Public health reached out <br />to the local municipalities seeking funding contributions to <br />share in the required expenses that impact the entire county. <br />The other municipalities understood the need and request <br />and gave assurances to provide 25% of their CARES <br />allocation from the state as provided in the attached <br />interlocal. After the BOCC executed the Interlocal as <br />described, the Washington State Department of Commerce <br />issued new requirements effecting such agreements. As <br />such, the Interlocal had to be amended to incorporate the <br />new regulations which included creating subcontracts <br />between the Cities and the County for the pass-through <br />funding. The revised interlocal and the subcontract was <br />developed cooperatively with the City of Ellensburg <br />attorney, Terry Weiner. <br /> <br /> Requirements for CARES Act Funding, include each local <br />government entering Interagency agreements with the <br />Washington State Dept. of Commerce (DOC) for <br />Coronavirus Relief funds. A pass-through of those funds <br />from the receiving agency to another agency requires an <br />interlocal agreement detailing the terms as well as a <br />subcontract authorizing the transfer of the funds. The <br />interlocal between the municipalities expressly authorizes <br />the execution of the subcontracts upon approval of each <br />party’s legislative body. <br /> <br />INTERACTION: The Prosecutor’s office was directed to draft the attached <br />resolution, revised interlocal <br />
