KITTITAS COUNTY
Board of County Commissioners

AGENDA STAFF REPORT

AGENDA DATE: October 16, 2018

ACTION REQUESTED: Approve Claim of Ryan T. Baker.

BACKGROUND: The claimant, Ryan T. Baker (“Mr. Baker”), claims damages of over
$1,875.65, for damage to his personal vehicle alleged caused by rock
falling from a county dump truck engaged in gravel spreading
operations. Kittitas County Claim # 201809070003.

INTERACTION: The incident alleged in the Claim involved a county dump truck
driving west on Hungry Junction, and Mr. Baker driving east on
Hungry Junction. Mr. Baker alleges “a rock flew off the dump side of
his truck and hit the front of my 2019 Jeep Cherokee.”

It is not certain the county caused the damage alleged in the Claim.
However, the damage to Mr. Baker’s vehicle is consistent with a rock
falling off a dump truck. For this reason, the Public Works Director
recommends approval of the Claim for the cost of repairs to Mr.
Baker’s vehicle.

RECOMMENDATION: Approve Kittitas County Claim # 201809070003, in the amount of
$1,875.65, contingent upon receipt of a signed Release of all Claims
from Mr. Baker. Deny Mr. Baker’s request for payment of a rental
car while his vehicle is repaired.

HANDLING: Original – Clerk of the Board
Copy – Auditor
Copy – Prosecutor

ATTACHMENTS: Claim of Ryan T. Baker
Letter from Public Works

LEAD STAFF: Christopher Horner, Deputy Prosecuting Attorney
Mark Cook, Public Works Director
