KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: February 6, 2018 <br /> <br />ACTION REQUESTED: Deny Claim of Suzanne Rector. <br /> <br /> <br />BACKGROUND: The claimant, Suzanne Rector (“Ms. Rector”), claims damages of <br />approximately $4499.15, for personal injuries sustained at the county <br />fairgrounds (Bloom Pavillion) as a result of her horse stepping on her <br />leg on September 3, 2017. Kittitas County Claim # 201712290016. <br /> <br />INTERACTION: The incident alleged in the Claim occurred during the Kittitas County <br />Fair. Ms. Rector claims a pig “spooked the horse” which knocked her <br />down and stepped on her leg and foot. Witnesses also suggest there <br />were trucks in the area that might have also agitated the horse. <br />Regardless, Ms. Rector signed a waiver releasing Kittitas County for <br />any damages suffered during the event. Additionally, RCW 4.24.540 <br />protects Kittitas County from liability for equine activities, which are <br />an inherently risky activity.
