KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: March 1, 2016 <br /> <br />ACTION REQUESTED: Deny Claim of Travis Kelly. <br /> <br /> <br />BACKGROUND: The claimant, Travis M. Kelly (“Mr. Kelly”) claims damages <br />allegedly caused by a temporary unavailability of funds, $6.29, from <br />his jail telephone account. The amount of $6.29 was deducted from <br />Mr. Kelly’s jail telephone account on February 3, 2016. This amount <br />was added back onto Mr. Kelly’s account on February 17, 2016. Mr. <br />Kelly was still able to make telephone calls during this time because <br />he had money in his commissary account he could use to pay for <br />telephone calls. Nonetheless, Mr. Kelly still requests damages of <br />$1.00 for each day the money was not on his account, plus $50.00. <br />The results in a total amount claimed of approximately: $64.00. <br />Kittitas County Claim # 201602160002. <br /> <br />INTERACTION: The Corrections Center has a policy requiring inmates to file a <br />grievance if the inmate disagrees with an action taken by Corrections’ <br />staff. Mr. Kelly did not file a grievance for this matter. However, <br />had he done so, the same outcome, restoration of $6.29 to Mr. Kelly’s <br />jail telephone account, would have occurred. <br /> <br /> Mr. Kelly has failed to provide any evidence or other rational to <br />support his claim of $64.00. While Mr. Kelly might have been mildly <br />inconvenienced by the temporary unavailability of $6.29 from his <br />telephone call, there is no basis for payment of damages for mild <br />inconvenience. This is true especially since he had the grievance <br />process available to him. <br /> <br /> Information was requested and provided by Commander Hoctor, who <br />recommends denial of this claim.
