KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: November 7, 2017 <br /> <br />ACTION REQUESTED: Partially Approve Claim of Teresa Ann Sloan & James Foode. <br /> <br /> <br />BACKGROUND: The claimants, Teresa Ann Sloan (“Ms. Sloan”) and James Foode <br />(“Mr. Foode”) claim damages of $1207.21 to repair the “front left <br />quarter panel” of their vehicle, as a result of damage allegedly caused <br />by the road gate at the county airport. Ms. Sloan and Mr. Foode claim <br />the gate’s safety devices had been disabled, possibly by an act of <br />vandalism. Kittitas County Claim # 201708160073. <br /> <br />INTERACTION: Public Works admits the gate at the airport was partially damaged at <br />the time of the incident alleged in the claim. However, when the gate <br />was examined later, there did not appear to be any damage to the edge <br />of the gate, which suggests the gate actually worked correctly, <br />meaning the gate closed on the vehicle and reversed according to <br />design specifications. <br /> <br />Furthermore, it appears Ms. Sloan’s own actions appear to have <br />contributed to the damage to her vehicle in that she <br />stopped/abandoned her vehicle in the midst of a gate cycle. A car <br />would have to be parked in the gate opening for at least 20 seconds <br />before the gate would start to close. <br /> <br /> Public Works recommends partial approval of this claim. <br /> <br />RECOMMENDATION: Partially Approve Kittitas County Claim # 201708160073, in an <br />amount not to exceed $603.61, subject to receipt of a signed Release <br />of All Claims. <br /> <br />HANDLING: Original – Clerk of the Board <br /> Copy – Auditor <br /> Copy – Prosecutor <br /> <br />ATTACHMENTS: Public Works’ Findings/Recommendation <br /> <br />LEAD STAFF: Christopher Horner, Deputy Prosecuting Attorney <br /> Mark Cook, Public Works Director <br />
