NOTICE OF APPLICATION TO ENTER YAKIMA ADJUDICATION COURT CLAIM NO. 01141 (S4-84509-J) INTO THE STATE TRUST WATER RIGHT PROGRAM AND APPLICATION FOR A NEW TEMPORARY MITIGATED WATER RIGHT PERMIT:

TAKE NOTICE:

That on November 2, 2017, Kittitas County of Kittitas County, WA filed application number CS4-01141sb10 with the Department of Ecology to enter Court Claim No. 01141 into the state’s Trust Water Rights Program. This will include a change in purpose of use and place of use.

That said right, under priority date of June 30, 1872, authorizes the diversion of 1.20 cubic feet per second and 275.64 acre-feet per year from Cooke Creek at 600 feet south and 200 feet east from the north quarter corner of Section 18, being within the NW¼NW¼NE¼ of Section 18; AND, 1200 feet north and 450 feet west from the south quarter corner of Section 18, being within the NE¼SE¼SW¼ of Section 18, both within T. 18 N., R. 20 E.W.M.

That said right authorizes water to be used for irrigation of 60 acres and stockwater from April 15 through September 15 within those portion of the E½SE¼ and the W½SE¼ of Section 18, T. 18 N., R. 20 E.W.M. lying east of Cooke Creek.

That the applicant proposes to change the purpose of use to instream flow and mitigation, and change the place of use to Cooke Creek, Cherry Creek, Wilson Creek, and the Yakima River.

That on December 29, 2017, James and Hazel Treat of Kittitas County, WA filed application number S4-35979 with the Department of Ecology for a new Temporary Mitigated Water Right Permit.

That said application is proposing to use mitigation made available from the above-proposed trust water right.

That said application is requesting the use of up to 1.2 cubic feet per second and 275.64 acre-feet per year from Cooke Creek for irrigation of 60 acres and stockwater from April 15 through September 15 for a 20-year period on those potion of the E½SE¼ and the W½SE¼ of Section 18, T. 18 N., R. 20 E.W.M. lying east of Cooke Creek and north of the Kittitas Reclamation District canal. 

That the proposed points of diversion are located at 600 feet south and 200 feet east from the north quarter corner of Section 18, being within the NW¼NW¼NE¼ of Section 18; AND, 1200 feet north and 450 feet west from the south quarter corner of Section 18, being within the NE¼SE¼SW¼ of Section 18, both within T. 18 N., R. 20 E.W.M.

Protests or objections to approval of this application must include a detailed statement of the basis for objections. All letters of protest will become public record. Cash shall not be accepted. Fees must be paid by check or money order and are nonrefundable. Protests must be accompanied by a $50 recording fee payable to the Department of Ecology, Cashiering Unit, PO Box 47611, Olympia WA 98504-7611, within 30 days from: February 14, 2018
