Mountain View, #504 Leachate Pond-Debris Fence Ellensburg, WA 98926 -- TERMS & CONDITIONS M2 INDUSTRIAL, INC. agrees to guarantee above fence to be free from defects in materials and workmanship for one year. Locating, clearing, grading and staking of fence lines is the sole responsbility of the customer. Customer agrees that M2 INDUSTRIAL, INC. shall not be held responsible for any damage to underground pipes, wires or hidden obstructions, and herewith waives any claims relating thereto. If property pins cannot be located it is recommended that the customer have the property surveyed. The parties further agree that if client fails to pay balance, M2 INDUSTRIAL, INC. may claim a lien on the premises upon which the within materials are to be installed. This proposal shall become a binding contract between the parties at such time as both parties sign it. Unless otherwise specified on page one under notes, all work is due and payable upon completion, no retention to be withheld. Customer agrees that the delinquent account shall bear interest at 1.5% per month from the date said account is due. Any alteration or deviation from bid specifications involving extra costs will become an extra charge over and above the estimate. Customer and M2 INDUSTRIAL, INC. agree that in the event it is necessary for either party to retain the services of an attorney to enforce any of the terms or conditions of this agreement that the prevailing party in any litigation shall be entitled to reimbursement for attorney fees and costs incurred and that the venue for any action at law shall lie in Kittitas County, Washington. The costs of all licenses or permits required for the construction of this project shall be added to the cost of the contract. This contractor, M2 Industrial, Inc., is registered with the State of Washington, Registration No. MTW0II*088DQ, as a general contractor for negligent or improper work or breach of contract in the conduct of the contractors business. The expiration date of this contractor's registration is 10-20-26. This bond or cash deposit may not be sufficient to cover a claim which might arise from the work done under your contract. If any supplier of material used in your construction project or any employee of the contractor or subcontractor is not paid by the contractor or subcontractor on your job, your property may be leined to force payment. If you wish additional protection, you may request the contractor to provide you with original "lien release" documents from each supplier on your project. The contractor is required to provide you with further information about lien release documents if you request it. General information is also available from the Department of Labor and Industries.
