request for a waiver or extension of a due date in the Timeline must be submitted to the <br />Department Key Personnel sufficiently in advance of the due date to provide adequate time for <br />Department review and consideration and may be granted or denied within the Department's sole <br />discretion. <br />h. For SHSP and UASI subrecipients, the total Law Enforcement Terrorism Prevention Activities <br />(LETPA) amount included in the Budget (Attachment E) must be used for eligible LETPA activities <br />following FEMA guidance. <br />i. All work under this Agreement must end on or before the Grant Agreement End Date, and the <br />final reimbursement request must be submitted to the Department within the time period notated <br />in the Timeline (Attachment F) except as otherwise authorized by either (1) written amendment <br />of this Agreement or (2) written notification from the Department to the Subrecipient to provide <br />additional time for completion of the Subrecipient's subproject(s). If funds are not required, the <br />Subrecipient shall notify the Department Key Personnel. <br />j. All costs for equipment and supplies must be incurred, and received, before the Grant Agreement <br />End Date. <br />k. Failure to submit timely, accurate, and complete reports and reimbursement requests as required <br />by this Agreement (including, but not limited to, those reports in the Timeline [Attachment F]) will <br />prohibit the Subrecipient from being reimbursed until such reports are submitted and the <br />Department has had reasonable time to conduct its review. <br />I. Final reimbursement requests will not be approved for payment until the Subrecipient is current <br />with all reporting requirements contained in this Agreement. <br />m. For SHSP and UASI funding, deviations from the Budget (Attachment E) are allowed as described <br />below and will require an amendment if the identified threshold is exceeded: <br />With Enduring Needs (EN) funding: <br />A. If there is only one subproject, the Subrecipient is allowed to move funding between <br />solution areas until cumulative transfers exceed ten percent (10%) of the subproject <br />amount. <br />B. If there are multiple subprojects, the Subrecipient is allowed to move funding between <br />subprojects until cumulative transfers exceed ten percent (10%) of the subproject <br />amount. <br />With National Priority Area (NPA) funding: <br />A. If there is only one NPA project, the Subrecipient is allowed to transfer funding <br />between solution areas until cumulative transfers exceed ten percent (10%) of the <br />NPA project amount. <br />B. If there are multiple projects within one NPA, the Subrecipient is allowed to transfer <br />funding between projects until cumulative transfers exceed ten percent (10%) of the <br />NPA amount. <br />C. To ensure applicable federal requirements are met, funding may not be transferred <br />between projects of different NPAs. <br />iii. Funding cannot be transferred between EN subprojects and NPA projects. <br />n. For OPSG subrecipients, any deviations from the approved direct budget categories will require <br />additional federal approvals and possibly a written amendment. <br />o. Subrecipients shall only use federal award funds under this Agreement to supplement existing <br />funds and will not use them to replace (supplant) non-federal funds that have been budgeted for <br />the same purpose. The Subrecipient may be required to demonstrate and document that the <br />reduction in non-federal resources occurred for reasons other than the receipt or expected receipt <br />of federal funds. <br />DHS-FEMA-HSGP-SHSP-FY25 Page 4 of 55 Kittitas County, E26-350 <br />
