ATTACHMENT "C" <br />INSURANCE REQUIREMENTS <br />Contractor shall secure and maintain in effect at all times during performance of work under this <br />Agreement such insurance as will protect Contractor, its employees, and agents from all claims, losses, harm, <br />costs, liabilities, damages and expenses arising out of Contractor's performance under this Agreement, including <br />but not limited to personal injury (including death) or property damage. <br />All insurance shall be issued by companies admitted to do business in the State of Washington and have <br />a rating of A-, Class VII or better in the most recently published edition of Best's Reports unless otherwise approved <br />bythe County. If an insurer is not admitted, all insurance policies and procedures for issuing the insurance policies <br />must comply with Chapter 48.15 RCW and 284-15 WAC. <br />At a minimum, Contractor shall maintain and provide proof of the following selected options: <br />® Commercial General Liability Insurance <br />• Coverage limits not less than: <br />• $2,000,000 per occurrence, for all covered losses <br />• $4,000,000 general aggregate <br />• $4,000,000 products & completed operations aggregate <br />• $2,000,000 personal and advertising injury, each offense <br />• The policy must be endorsed to include the County and its officials, employees and agents <br />as additional insureds. <br />© Commercial Automobile Liabilitv Insurance <br />• Automobile Liability for owned vehicles used in contract performance and hired and non - <br />owned vehicles, with limits stated below. Transportation of incarcerated individuals or <br />pollutants is not contemplated; MCS 90 and CA 9948 endorsements are not required <br />unless the parties add such transportation by written amendment. <br />• Coverage limits not less than: <br />• $1,000,000 combined single limit <br />® Excess or Umbrella Liabilitv <br />• Contractor shall provide Excess or Umbrella Liability coverage of $1,000,000 per <br />occurrence and $1,000,000 aggregate applying at least to Commercial General Liability. <br />Any higher limit or application to additional underlying coverage requires a written <br />amendment and an equitable adjustment for the incremental premium. <br />• This requirement may alternatively be satisfied through Contractor's primary Commercial <br />General and Automobile Liability coverage, or any combination thereof. <br />• The policy must be endorsed to include the County and its officials, employees and agents <br />as additional insureds. <br />• Coverage shall be "pay on behalf', with defense costs payable in addition to policy limits. <br />• There shall be no cross liability exclusion precluding coverage for claims or suits by one <br />insured against another. <br />® Workers' Compensation & Employer's Liabilitv <br />Kittitas County Agreement for Services (rev. 5/14/25) <br />Page 9 of 23 <br />
