any required Part 2 provisions. Those privacy terms control over any conflicting provision of <br />this Agreement. <br />d. To acknowledge that incarcerated individuals may refuse VALLEY HEALTH AND <br />COUNSELING services except to any extent mandated by law including court order. <br />e. That the VALLEY HEALTH AND COUNSELING MHC's activities will not go beyond <br />those duties as approved by KCJ and VALLEY HEALTH AND COUNSELING except as <br />otherwise provided by law. <br />f. VALLEY HEALTH AND COUNSELING agree to remove any MHC provided to KCJ <br />immediately upon written request by KCJ. <br />g. Contractor will bill an eligible third -party payer only when coverage is active on the date of <br />service, the service is lawfully covered in the correctional setting, and Contractor is enrolled <br />and authorized to bill. If coverage is inactive or cannot be verified at the time of service, <br />incarceration makes the service ineligible for third -party payment, or a claim is denied for a <br />reason other than Contractor billing error, the County will reimburse Contractor at the <br />Medicaid -equivalent rate defined in Attachment `B." Contractor will not balance -bill <br />incarcerated individuals. <br />h. Specific services may be cancelled or rescheduled for good cause by either party. "Good cause" <br />includes documented security, safety, clinical, or unforeseen staffing concerns affecting safe <br />operations.
